Filing asylum after one year since arrival

I came here to study MSc at September 2023 and I'll be graduated in 3 months.
I am gay and from a super conservative muslim country, I've also had several partners here and they can testify if it's needed.
I just want to file an asylum, one thing they will definitely ask is that "why did you wait 1 year after your arrival and then filed?". I think this can be a big credibility issue even though I have strong evidences.

What do you think? Any insights for how long does it take for second hearing and get protected person status?

I'm totally frustrated at this point, I'm looking for a TEER 0 - TEER 1 job for 4 months and still no luck. And my friends keep telling me "You are literally a gay man in an Islamic country, why don't you file an asylum?" And I was like "I have more control over my life as an International student rather than a refugee"

But I'm near collapsing now, I cannot handle this situation anymore, I'm running out of my savings and still haven't found a job yet, and in this case I have to go back to my country, however I cannot, as a gay man.

It generally takes around two years to get a hearing and know if your claim is accepted (although some get through faster). If your claim is accepted, then you become a protected person. Then you apply for PR and there is another waiting period before you become a permanent resident.

gay is best claim. they dont question too much but take passport. problem is while waiting for work permit you cant do anything. finding cash job is very difficult. there is financial help but lot of paperwork and it will take long. try to convince them to issue wp at border and take medical with you.

There is no best claim. A real fear of persecution is what is important. Yes there will be scrutiny with regards to any application. If you are not actually gay then you could run into serious issues if you then try to sponsor or get married to a non-same sex spouse. There will be extra scrutiny for international students attempting to claim asylum to remain in Canada.

Asylum is not a fast process and as you are aware has significant consequences on you and your extended family even if approved. It appears as though you have a genuine claim but it is far from an easy option. It is up to you to weigh the pros/cons. Things like not visiting your home country for 5+ yrs, potential difficulty having family come to Canada, the inability to travel out of Canada for up to 2+ yrs, etc.

Just like to point out that filing asylum isn't going to improve your chances of finding employment. The two are not mutually exclusive.

isnt it good asylum is not a fast process? we get more time. refugee is the only option when canada dont offer any other option. if not claim refugee people get deported. there are criminals claiming refugee and staying forever we are just normal people. sometimes its the only option.

H&C is the option when there is no other option, not refugee.

Keep I. Mind, a failed refugee claim can also result in deportation.

Please don't post false information. Deportations happen regularly. Anyone can easily find examples on canlii.

No. I know someone who got deported to the her country after almost 20 years. She was refugee. Not Canadian citizen. But keep going to back home for vacation. At the end they noticed and deported her. They canceled the citizenship application.

I do believe we as normal , honest and genuine ppl don’t scam and cheat the system like you!. We as normal ppl when we see something is wrong we call it wrong. Guess hard for you understand it’s basic moral which you might be lacking !
