I am American and my fiance is Canadian. We can qualify or common-law but we plan on marrying next Halloween. Should we wait to file, as my application would change ( as would his financials as he is going full time)? It seems as though it would be easier to file as a married spouse. Just wondering.

You would need to update CIC and tell them the marriage, and that would probably delay your file anyway. Try to have everything ready before the marriage (FBI check, medicals, evidence, Option C, photos); then after your wedding you just need your marriage license and you can send the file off.

We were in the same boat; we got married at the end of August and filed in early October.

I would just wait. I'm not sure, but I would think that applying as common-law and then getting married would cause some delays.

That's what I was thinking as my name would change legally for starters as would my passport so I'd need a new one. Thanks in advance.
