Dear All

I did applied for Federal Skilled Worker Category just after new quta opened on 26th June 2011. According to data my file was reached at Canada Intake office on 10th July 2011.

At the time of applying the 500 quota was empty. Now on 16th July 2011 CIC issused new form for federal skilled worker.

But my application was reached before it. Now just before a week i received the letter frm CIC that 500 quota in 1122 cateogry is reached.

Same case happned to my freind whose file was ther in CIC on 18th July 2011. But he also reeived the same refusal letter.

Now is it possible that in very first 10 days the quota can be full n still on website total application in 1122 says 0.

So according to discussion with some of my friends we came to conclusion that because we filled old forms they just rejected with out processing, whereas if we would have applied after 15th July 2011 with new forms than it would have accepted.

what do u think guys.. I think its really unfair because on website it was cleraly mentioned that you can send the application. if they would have mentioned like no file would be accepted with old forms than we could have wait till 15th july 2011 for the new forms. again they dint intimated us that they would issue the new form anyways.

so me and my both friend received the same letter with same reason.

Can you just provide your opinion freinds??? can we do something on it?

Unfortunately it is true that the CAP for 1122 was filled on 11th July itself. And yes, it is utterly unfair that the websote wasnt updated on time. Here's a letter that a friend from this forum rcvd. This will throw some light, I am sure.



Guys, I just received this letter from CIO explaining about the CAP REACHED situation on NOC1122, my app filed in july 11th and I didnt make it. They said even that they dont return apps anymore! But I spent about a thousand bucks in certified translations and I need them back to re-apply next year! Hope they will send me at least the trasnlations and IELTS.

The second set of Ministerial Instructions (MI-2) introduced on June 26th, 2010 implemented caps on the Federal Skilled Worker program. The cap is a limit on the number of complete applications considered for processing. Under the current set of Ministerial Instructions (MI-3), Citizenship and Immigration Canada (CIC) will only consider a maximum of 10,000 complete applications under the list of 29 eligible occupations. Within the 10,000 cap, a maximum of 500 federal skilled worker applications per occupation will be considered for processing each year.

Under MI-2, ten eligible occupations reached their caps before July 1st, 2011. Professional Occupations in Business Services to Management (NOC 1122) was the first to reach its cap of 1,000 applications on October 27, 2010. As such, many representatives and applicants were disappointed and were ready and waiting to submit their applications in July 2011 when the caps re-opened under MI-3. Therefore, the Centralized Intake Office (CIO) in Sydney, NS received a high number of applications from the very first day. Within the first week of MI-3, the CIO received over 1500 applications and on July 11th, 2011, just 6 business days after the instructions were introduced, the CIO received 500 complete applications for NOC 1122.

Due to the high volume of applications that the department receives, it not possible for the CIO to receive and review each application for completeness on the same day that it arrives at the office. CIC updates the number of complete applications received at least once a week but as noted on the website, the figures are meant as a guide only. There is no guarantee that an application that is sent now will fall within the cap by the time it reaches the CIO. Please be assured that we are looking into ways to minimize this natural time lag between the CIO's processing efforts and our website updates, particularly for the most popular NOCs.

As the cap was reached before receipt of your clients' applications by the CIO, it is not possible for CIC to reconsider them for processing. We encourage you to visit our website frequently to see if any changes are made to the program and to explore other possibilities for your clients.

With regards to return of documents please be advised:
For all applications submitted to our office on or after 01 July 2011, please be advised that applications and supporting documents are part of the permanent record for a client and must remain on file. The instruction guide (IMM7000) for Federal Skilled Workers directs applicants to make a photocopy of the application for their records.

The guide states: You must gather and submit to the CIO all the documents listed on the Document Checklist (IMM 5612). Documents from the checklist are only to be submitted once to the CIO. Do not submit documents that are not found on the checklist and do not send duplicates of your application or documentation.

Documentation submitted with your application will not be returned. You should obtain multiple originals of any documentation submitted with your application (such as reference letters, police certificates) so you are prepared if you need to submit a new application.

In rare circumstances, our office will returned certain ORIGINAL, irreplaceable documents. If you have submitted original documents; i.e. current passport, original Marriage Certificate, in error with your application please confirm the following:

· Mailing address to which your returned documents are to be sent.

· The specific original documents you wish returned. Please ensure your list is complete as this is your only opportunity to request return of documentation. Further requests for return of additional documentation will not be actioned.

Applicants are now permitted to submit a clear photocopy of their language test results with a new Federal Skilled Worker (FSW) application only when:
a previous FSW application (with the original test result form) was submitted on or after June 26, 2010; and
the application and original test result form were not returned to the applicant by Citizenship and Immigration Canada (CIC); and
The tests results are still no more than two years old at the time the new FSW application is submitted.
· Of the two IELTS test formats, only the IELTS – General Training test is accepted by CIC. Applications with the Academic IELTS will be returned.

Photocopies of test results will only be accepted when they are accompanied by a photocopy of the refusal letter from CIC and an explanation that CIC retained and currently holds the original test result form. Every photocopy that is submitted will be verified online to ensure its authenticity.

thanks once again.. thn i think its just CIC who dint update the total file and let other thousand s people like me send application thinkin, still there is a space in 1122..

but its unfair for all as so many people had expectations and they did hard work and spent money on preparin the file.
