Feeling Discouraged and needing advice

Hi everyone,

Im sure some of you have read my other posts, as there have been many! I just have a question dealing with being inadmissible to Canada.
Background:
1.) Met my Albanian husband late October early November 2008 while I was on vacation in Greece and he was there working illegally.
2.) After maintaining a relationship via the phone for 6 months I moved to Greece where he and I lived together for 4'ish months. He was then deported to Albania at which time I moved him him to Albania for 3.5 months.
3.) We applied for a Visitor Visa on which we told some lies (just weren't thinking,didn't know much of the process, and it seemed like a good idea at the time - which now haunts me daily)
3b.)My mother invited him, she stated that we met in Albania, when we really met in Greece.
3c.) We said he had never been deported or detained.
3d.) He was issued a passport with the wrong birth date, it was off by a day, we tried to get it fixed - they said that it was correct. It was not correct, since then they have fixed it and issued him a birth certificate & passport with the correct birth dates.

So either way he was denied the visa, the Immigration Officer was worried he wouldn't leave when the visa expired.

The issue I have now is this: Because of these lies, can he be found inadmissible to Canada? I knew these past lies would work against us, and I didn't think they would make us inadmissible which is what an immigration adviser suggested to me ..... Or would they have deemed him inadmissible on the "refusal" letter that they sent? And if he is inadmissible what can we do? Or is that sort of "the end of the line"?


Every time I feel as though we are making headway with the application, and getting close to shipping it off I feel like we get knocked back down to a starting point. This process is so tiring, stressful, and emotionally draining. Sometimes I just wonder what the point of moving to Canada really is. I was completely content in Albania, despite the poor living conditions & lack of work it was nice, cheap, friendly people and I enjoyed my time there. Im starting to wonder if having higher wages, better health care, and less power outages is really worth my sprouting grey hairs in my bangs (Im 21!!). I would be happy anywhere in the World, as long as I had my husband with me........ Im sure many people feel this way though at least sometimes?

The immigration process is so ambiguous, there is no definitive answer. Do you have to disclose information that would prove that you have not told the truth in past situations? If these things are to be found out they will obviously work against you, I'm sure applications have been denied for lesser reasons.

As for moving there, if you guys can become financially sufficient then why not. Be wherever you're happiest. That being said, is there a country in which you guys could both move to in which he is visa exempt from entering?

I know if it wasn't for my son, I would move to Thailand in a heart beat. Because of him I just feel it would be a selfish move in alot of ways. If you guys don't have somebody dependent on you, then fly at it.

The visit visa refusal will have no effect on your application.And 90% of the time they dont even refer to them.Answer all questions on your application truthfully.The being deported in Greece might not have as much effect as you think it will.He was deported because he was there illegal he did not get deported because he committed a crime or something else.People get sent out of Canada all the time for the same reason.They fill out an ARC and are approved everyday.So dont stress on it too much.If you have the paper from Greece as to why he was deported that will help you alot to prove it was not because of a crime.
Just answer the questions in the app honestly,then if it comes to an interview you wont have to worry about them catching you in lies if you dont lie correct.

I don't have any advice, just sympathy and empathy! Just do the best with your application, it's all you can do.

Thank you, I think some sympathy and empathy is what I need! Just need feeling down and discouraged, and not sure what to do. It would be great to live in Canada, I have my family & friends here, I would like to go back to school..... But I hate the uncertainty and the stress that comes with this whole process. Obviously starting this process I wasn't expecting a cake walk, but it has been a lot hard and more trailing that I had originally thought it would be.

@iarblue - I really hope you are correct and that the visitor visa refusal will not affect anything. And yes, we are definitely going to be truthful and answer everything to the best of our ability for the sponsorship application. Not going to lie out of sheer desperation and feelings of hopelessness again.

@ Wilder1047 - There are a couple questions that will sort of shed light on our previous lies. We will have to say that he was deported, and also that he was issued a passport with the wrong date which we used to apply for the visitor visa. But hopefully they won't connect the dots? Once I am financially more stable I think for sure I will pack up and move to Albania so he and I can at least wait it out together, and if it is denied (finger crossed it isn't over a previous lie) at least i will be in Albania with him!

@lynw - really thank you. I think what I needed was to just feel a bit of sympathy and empathy. I know everyone on this forum is going through the process, and probably feeling the stress of things. But its good to have a bit of empathy! And yes, its so true that all we can do is try our best with the application. I just hope that the lies of the visitor application wont distract them from seeing how crazy he and I are about one another.

I guess we must have been in the 10% of the time they DO refer to visit visas ... we had forgotten to disclose a refused visit visa on our application. They must have dug a little and found the refused visa themselves, as they asked my husband about it during his interview. But they didn't seem overly concerned about it and eventually he did get his PR.

Probably he will not be found inadmissible - he didn't get deported from Canada, after all. But if he is, the ban is for two years, and after that he can apply again and has a good chance of being accepted. I know someone who was deported from Canada, therefore banned for two years, and who is now in Canada legally with his wife. So don't despair.

Thank you to everyone who responded to me, and gave me their input. This forum has really been a lifesaver in many ways – its great being able to read about other people’s cases, and what went well for them or worked against them. And it’s also wonderful being a part of a “community” who is all going through the same things, and feeling the same way at certain times. I’m going to try my best to remain positive, and believe in a positive outcome. And it’s wonderful to hear that past applications for things like visitor visas don’t make or break the sponsorship application. And I suppose that if worst came to worst and if he were inadmissible for 2 years it would be very easy for me to just move to Albania – which I think I will do anyways once we finally mail these papers off so we can wait it out together. But once again, thank you to all who responded to give advice or encouragement. I wish you all luck on your sponsorship cases!
