Just a quick question! When might there be a decision regrading the cases? sometime this year? I'm usually contributing at the CEC discussion forums so I'm not familiar with this particular thread. sorry about that! I wish everyone best of luck!!!

What I understand from above postings that nothing important will be on 14 Nov CMC. So we have to wait for 23 & 30 Nov.

Mr. Tim is doing well and wish him for the good results.

I also see in the old cases/working manual etc. that granting leave itself has win within and an indirect order to CIC.

how come that on the Federal Court hearing list all these cases have the same hearing appointment, and in the same time? is this the conference which the federal court called for?

Concerning IMM-7502-11 the file of MOHAMMAD MEHDI EMAM v. MCI which is the lead file now for Tim Leahy
This is one of the non terminated files, as stated in the court records dated November 2011, so how come this case is still pending the in the court? he should have had his visa already as he s one of the pre JUne 14th litigants whose file was not terminated by budget bill C-38?!!

On 14th or 23rd November 2012, we will know the total number of litigants. My guess is around 6000-7000 litigants. But as the case proceeds, it may even reach the magic figure of 10,000 litigants. Anyhow, this will just be around 10% of the total warehoused applications. Even if the judge finally rules in favour of the litigants, the CIC still has a lot to gain. Meaning, it need not have to process the remaining 90% of the applications and will have to just refund their fees (without interest). So, finally it will be a WIN-WIN situation for us and CIC (and, ofcourse, the lawyers of both sides and the court). The losers, ofcourse, will be the non-litigant applicants, who will have to be just happy with their refunds and worry for the rest of their lives for having lost their long-cherished dreams.

The only winners in this whole fiasco are the lawyers. They're getting rich off the hopes of a bunch of poor saps who don't have a chance in hell of getting anywhere with this case.

I'm not sure which is more unfortunate - the fact that all these people were heartbroken to learn that their applications are being thrown out, or that they're delusional enough to think that this lawsuit will turn back the hands of time.

Since this lawsuit doesn't really affect me because I'm an American, I'm just trying to think of scenarios that could be in favor of these guys: if Judge somehow rule in favor of the litigants, more and more new applicants will hire lawyers and maybe if the Judge can get a piece of the cake if you know what I mean...Highly unlikely scenario but I'm sure the lawyers and judges aren't saints lol

This is the latest entry that could be found in IMM-8747-12 (YANJUN YIN).

Letter from Robert Blanshay, counsel to the ABEDI Imm-8669-12 group dated 12-NOV-2012 ...ouor firm is not in receipt of the certification and conversion motion materials regarding the Yin and Tabingo applications... received on 13-NOV-2012

Note this entry is very strange, because, Robert Blanshay is the counsel to ABEDI and this entry could not be found in ABEDI's file of IMM-8669-12. It could also not be found in TABINGO's file of IMM-5635-12. YIN's counsel is Lorne Waldman and TABINGO's counsel is Mario Bellissimo. So, what is the connection between Robert Blanshay, Lorne Waldman and Mario Bellissimo? Is Robert Blanshay leading the other two?

It is strongly speculated that a whole new lot of cases, numbering thousands (the fresh cases of all lawyers put together), will be filed today morning in the court much before the CMC begins at 4 pm.

There is also an expectation that Justice Barnes may rule on Tim's motion either today or on any of the other two hearing days of 23 and 30 November 2012.

What I think todays CMC is for announce or set a cut off date for filing any leave applications. That may be todays or before 23rd Nov 2012. so that the matter will be closed for the rest of pre-2008 applicants.
