FBI Check

I spent a year studying in America, but I went back to the UK for a month in between my time there. I was there for 4 continuous months, UK for 1 month, then USA again for 5 continuous months. Am I required to get an FBI check for this?

Also my work permit is close to expiring (2.5 months), and I'm hoping to get my ITA in March. I'm worried I won't get the FBI check in time. I need to send my PR application before my work permit expires to apply for a BOWP. Can I send my PR application way before I reach the deadline explaining that I have applied for an FBI check and am waiting for it, but need to send the PR application to get my BOWP?

Yes, you need to get FBI clearance since your total stay exceeds 6 months in 2 visits.

No, you don't need it.

• For countries in which the applicant no longer resides, the police certificate must have been issued after the last time the applicant stayed in that country for 6 months or more in a row.
