Family Sponsorship + Work Visa Together

I have two questions regarding family sponsorship and work visas.

In short: My wife is dual citizen (Canada/US) and I am US only. We both live in the US. We plan to submit my application in mid August and move to Canada at the beginning of September to get settled and so that she can find work. (I know I'll only be technically visiting during this time)

Question 1: On our application under "class of application" I am uncertain whether to check:
  • I am currently living in Canada with my sponsor and I am applying under Spouse of Common-Law Partner
  • I am currently living outside Canada and I am applying under the Family Class.
  • I am currently living in Canada and I am applying under the Family Class.
Am I correct that the first option is known as inland and the second two options are outland? In that case, I believe it is best to pick outland for the faster processing time and ability to get a work permit. Is there any insight into which option I should select?

Question 2: I am under the impression that I could also fill out a work permit form and submit it simultaneously with the family sponsorship. Is this correct? If so, does it matter which option I selected above?

1.) You are correct that the first option is known as Inland and the second two options are Outland.

Outland processing seem faster than Inland for USA citizens.......however, you can't apply for Open Work Permit with Outland spousal sponsorship application.

2.) You can only simultaneously submit application for Open Work Permit (OWP) and Spousal Sponsorship application for PR with Inland.........with Inland, OWP is approved within 4months.

Thanks for your reply. Do you know if this means that an outland application essentially ties my hands from working until I am approved or if there are any other avenues to explore? For example, can I apply for a work permit after being approved in principal, or look for work and get sponsored by an employer or apply for skilled worker visa?

if you apply Outand....and come to Canada as a visitor.....you are not eligible to work......you have no application for work permit and can't apply for a work permit with Outland sponsorship.

As a visitor, nothing prevents you from looking for work and get sponsored by an employer or apply under skilled worker program.

If you apply Inland.....OWP could be approved within 4months......for USA citizens, PR approval may likely take up to 12months.

If you apply Outland......you are not eligible for OWP........ for USA citizens, PR approval may likely take less than 12months.

Any particular reason you are waiting until August instead of submitting now?

1. As you live outside of Canada, option 2 is the only one you can select.

2. You must be in Canada and apply inland to be able to include an OWP app. You can't apply for the OWP with an outland app.

You won't qualify for a work permit based on the outland app. To apply for a regular work permit, you need a job offer from a Canadian employer with an LMIA. The LMIA process takes months, has strict requirements and costs $1000, so there is little chance of being able to dot his. Alternatively, if your profession is listed under NAFTA and you can get a job offer, you could apply for a work permit without an LMIA.
