Hi, my boyfriend and I are looking to immigrate to Canada next year (hopefully). However I would like to know what our options are.

We have been living together for almost a year (from April 2018) and therefore would fall into the Common Law Relationship category.

1. Could I apply for PR - if I do well in my English Test I could potentially score 441 points. However I would need to apply before September before my next birthday. Once I am granted PR could he come as a visitor on his British Passport for 6 months and during this time apply for PR (Family Sponsorship) and an Open Work Permit? Therefore apply Inland Sponsorship.

2. In order for him to come with me, would he need to be on my PR application as a common law partner? This would ultimately lower our scores to 437 at the most! and looking at the trends this was not met in 2018.

Would they question why he was not included on my PR application initially if we chose option 1 (if feasible).

Please clarify.

My understanding is that if you are common-law at the time of application (ie have lived together for a year continuously) you must include him on your PR application otherwise you will never be eligible to sponsor him (even if you married in the future).

Really? So if i was to submit the application in March (just before we qualify as common law partners) would this help?

From reading other people's stories, I believe it matters whether or not you have common-law status when you land not when you apply. So even if you applied in March once you became common-law the next month you would need to have him added onto your application before you landed to be eligible to sponsor him in the future. I'm not an expert on this situation though, just have read other threads about this, so I will leave it to someone with more experience dealing with this to clarify!

To clarify, you can mention him in your application as common law spouse who is not moving to Canada with you when you submit your application. Later on, you can get your PR, get married and apply Inland Sponsorship.

Please consider preparing the supporting documents, as early as possible in case you are not married while submitting your sponsorship application.

To further clarify, Not you only mention your common law partner in your own PR application, but also you need to include him as your non accompany common law partner, and he must do the medical exam and pass it. If he fails the extensive medical exam, it will jeopardize your own PR application. And if you didn't include your common law partner on your own PR application, and he didn't do the medical exam, and you landed as PR, then you can never sponsor him, not even you married him later on.
