Family sponsorship in Canada Class completing the requirements 2012

I am holder of visitor visa here in Canada. I am going to apply for Family sponsorship inside canada. But i have a little problem in my requirements.....I was married in Pinas and i have 2 kids... but we was illegally seperated since 2009. Is it possible for me to file a divorce here in Canada and submit the papers to the immigration?How about my custody papers for my kids.... do i really have to go back home to file for the custody? What if my ex will sign a paper stating his allowing my kids to immigrate here in canada with me with out going to court, is it possible too?

I hope someone could help me with this... im really confused....

You may be sponsored as the common-law partner of your Canadian partner if you cannot obtain a divorce from your husband. You will need to establish one year's (12 months) continuous cohabitation in order to qualify.

Custody of your children is between you and your ex, and if he does not wish to go through a court proceeding to establish custody, then you still need something in writing, preferably attested by a notary or some such person, that he is willing to allow the children to emigrate.

Thank you for your answer.....Actually we are already considered as common-law partner of the Revenue Canada and Quebec since June 2011. Actually i have a baby from my common-law partner and its under my name all the checques the government send to our child....
