Hi everyone,

I am a PR of Canada and about 2 years ago I got back in contact with my ex girlfriend who does not live in Canada. We basically started dating, telephone calls, Skype and messages. We tried to make arrangements to meet a few times but my job or her job comes in the way. She applied for a visitor's visa but was found inadmissible and ban for 2 years due to the fact that the agent who completed the application made an error in one of the questions and put "no" instead of "yes" to the question of if she ever applied for a visa before. I want to marry this girl but I am really afraid that due to us not seeing each other for 15 years the application will be rejected. please advise!
 
Well for start, I would be irate and pissed at that agent and would try to have him rectify the issue immediately and get a refund for his careless mistake. other options are available too, like for one does it have to be in Canada? Can you not move out there at all? I did this as I am presently in the UK with my spouse and my visa is coming to an end and am now headed back over in August and sponsoring them over.

thank you for your prompt response. I was really pissed with the agent, I tried to get the embassy to appeal the process but they informed my gf that there was no appeal process. she did send a statement of the chain of events that took place when the application was done and that she took full responsibility for the error since she was neglectful to sign the document without going through it with a fine teeth comb.

I have a really good job here in Canada and my girlfriend is from Barbados. Her job is good as well but it would be more beneficial financially if we lived in Canada. this is so frustrated, I let her go once having to move to Canada and we lost touch along the way, I never forgave myself for this. We love each other and believe we belong together.

I will be thankful for any information and/or advise you may give.
 
When did she receive the 2 year ban? Has the 2 year ban period now passed? (She can't be sponsored until that 2 year period is over.)

Unfortunately it doesn't matter who placed wrong information in the application. The applicant is ultimately responsible for ensuring all information in the application is accurate.
 
The 2 year ban would be up in April 2016. I think we are past placing the blame, we just need to sort this out and move on with our lives.

You can sponsor her provided you are either married or common law (have physically lived together for at least one full year). You should plan to have the application ready to submit as soon as the ban is over in 2016. The fact you haven't seen each other for 15 years shouldn't be an issue provided you can provide sufficient evidence your current relationship is genuine (e.g. proof of communications, visits to see each other, any shared accounts or assets, wedding and other photos, etc.). You will need to visit her a few times if you want CIC to believe the relationship is genuine. Having an online relationship only will likely be very suspect to them.
