If a family member went up on a visitor visa and overstayed but their spouse got an ITA but didnt add them as accompanied spouse because of marital problems. Can the spouse sponsor them in the future if they sort out their marital problems?

Yes it's possible but note that even if the spouse is non-accompanying you'll give to provide his/her medicals/PCC and POF (if applicable)

Sure, even if she's a non-accompanying spouse you would still have to show POF for two people (assuming you have no children).

This doesn't apply if you're a CEC applicant or if you have a valid job offer.

If the spouse is not included in the PR app, even as non-accompanying, they will be forever excluded.
