Hello, so myself (Canadian citizen) and my husband (American citizen) are trying to find the best possible way for him to immigrate here whether that be INLAND or OUTLAND. We have had lawyer consultations and I have even called IRCC to double check if an OUTLAND spousal sponsor can apply for the OWP. The lawyer and the IRCC both said that it has to be on the INLAND application but I was wondering if they were getting confused with the part where you need to be WITHIN Canada to apply for OWP.

So I’ve read here and seen that video everyone recommends about the OUTLAND and OWP being allowed. I know it was recently changed and maybe that is why we were advised to do the INLAND.

So I suppose my question is: If we applied for the OUTLAND visa and then he travelled to Canada after the AOR was received and applied for the OWP while in Canada would that work (his name is on our lease as well if that helps)? He also has ailing family in America which is why we wanted to do the OUTLAND so he could visit them with less risk if need be. After he applies for the OWP can he leave while that’s processing if he needed?

If he did leave after the OWP application was submitted would it be smart for him to stay out of Canada until it was approved so then he would be returning as a worker? (The IRCC agent had mentioned something about him returning with his OWP rather then as a visitor)

!!!!!Can anyone link me to the official IRCC page that says OWP was added for the OUTLAND visa I have yet to find the “official” change for it!!!!!

I think your consultants and IRCC are both daft, this application says nothing about what type of spousal app is required - so it doesn't matter.

I 100% agree that they are daft! They stressed me out to no end and wouldn’t listen when I tried to explain that it was recently changed that an OUTLAND can apply for OWP.

I will maybe wait for the “high google-fu” XD people to find the announcement or I’ll keep trying to find it. I trust peoples facts and knowledge on here because I see peoples success stories with OUTLAND and OWP. I just didn’t know if he could also leave while the OWP was processing but if he doesn’t have to he won’t

I think the only potential issue is a delayed OWP, but since OWP's tend to take four months or so lately, main thing is to be aware it may not happen quickly (limting ability to work). As a US citizen chances could be that he'd get the PR before the OWP comes through anyway, hard ot say.

as long as they didn’t secretly change the OWP rules we are literally doing the OUTLAND application right now! I think the application for OUTLAND said like 10 months processing time so hopefully it’s around that time!

Our Outland sponsorship is in process of background and eligibility check, can I apply for work permit as an outland ?

If you are in Canada then yes.

Can I apply for Visitor Visa? What are the requirments ? If the application goes through while the PA is in Visitor Visa in Canada, does the PA need to come back and go back to canada again ?

Yes, you can apply for a TRV based on having received AOR.

I also realized there is inconsistency with the language in the past few weeks.

Can the spouse who applied outland under Family Class apply for an OWP outside?
