Hi ,
Please help me , is anybody in same situation like me ?
I came from uk in February 2017. I got married with Canadian girl in March 2017 . Actually I was student in uk(England) . Now my wife is about to applying. But my question is that if a body was illegal in uk does effect on Canadian visa ? I am worried about it tbh . Please seniors help me .

It won't affect it majority. Your background check might take a bit longer than usual. Make sure you don't hide this fact though. When you submit Schedule A later on, mention the fact that you overstayed. Have you got police clearance certificate from the UK though? Because you are going to need that if you've stayed in the UK for more than 6 months.
My husband and I are in the exact same situation. He overstayed in UK after his student visa expired in 2012 and he returned to India in January of 2017 and we got married in February. He did get his police clearance from the UK before he left. I applied for him in July. The file is in New Delhi since October.

Yeah , I got the police certificate. But I filled the schedule A form and sent to my wife in Canada this week . I filled all the form . One more thing there is no box or options in schedule A background form in which I mentioned the overstayed . Thanks a lot for answering.

Generally on a spousal PR application they don’t hold overstays or illegal status in other countries aginst you if you are upfront about the information. I believe that a bigger concern would be if you had withheld or omitted that information on a visa application to enter Canada previously. That could be found as misrepresentation and result in a ban from Canada, which would make you ineligible for sponsorship until the ban is complete. Others can confirm this.

Never lie to IRCC. It’s one of those things they take very seriously.
