Family class sponsorship refused - Misrepresentation - what's next?

I did not update my marital status when I signed my landed paper.
Just understood it's a HUGE mistake when my spouse sponsorship application was refused.
I called CIC, the agent said it's categorized as MISREPRESENTATION.

Questions, please!
1. Is there any way to fix my mistake, to update CIC after what had happened and may re-apply?
2. Am I subject to removal from Canada, because of misrepresentation?
3. Will I lose my permanent residency as well?
4. What should / could I do that might help my situation?


Any reply is really appreciated!

1. Not really, your spouse is no longer a member of the family class and cannot be sponsored.
2. It is quite likely that you will be reported for misrepresentation
3. If you are found to have misrepresented your status, reported, you will be removed, unless you can prove Humanitarian and Compassionate grounds.
4. Better hire a lawyer, experienced in Immigration work.

I applied for PR in CA and I was single. When it was in progress (took a while), I went abroad for marriage purpose. Got the date to signed the landed paper, flew back right the weekend before (back on Sat 10 pm, appointment was Mon morning). I did mentioned to the agent I need to update my status but he said nothing I can do, the application is done. I completely believed what I did was sufficient at the time (now just realized I was so careless and retarded, how come I didn't think logically!) I also didn't ask more questions, if it's okay so, if there is any consequences, what about sponsoring, etc. The agent didn't say anything, either. I don't blame him, but it would be really helpful and appreciated if he had mentioned that it was a wrong situation. I took it really easy. I didn't think of finding more info, more sources. I hung up and went home to sleep (jet-lag). I thought I asked the right person, if he said no need to do then I don't do.

I really didn't know/understand that it would be so complicated and so serious when I want to sponsor my husband later. Now I even found out, not talking about sponsorship, just about myself, my PR status, it is a very wrong thing. Even I don't go for sponsorship, if one day CIC found out that it was a false information, my PR would be revoked, I will be subject to removal anytime now!

Pffft... so helpless, too bad I just understood this 2 days ago. Really really so hopeless, so upset to myself. Life's been so hard for me, but I really can't face it this time. Feel like dying

It won't make any difference.
Not a big one, but I'm hoping there is. Forget about my sponsorship now, but for my status, if possible, I would do anything I could. It'd been a looooooooong way to get to where I am today. So please, any comments or suggestions, would really appreciate it!

I see. Well, the one thing you could have done was to not land. Instead, you should have returned your documents to CIC and told them the reason was because you got married before landing. They would have accepted that and they wouldn't have said you misrepresented your case to them.

I really should have done that way. I even think I should had been browsing immigration matters since I arrived as a new immigrant. There are so many information, forums, blogs which are clear and easy to understand. Too bad and too late I'd just learnt it after all this happened. I found these immigration forums just last week. I even just understood I could be removed 2 days ago! OMG, such a shallow mind!

Just sharing my experience, talking to an agent or calling via phone doesn't help at all. I called CIC right after I found out the refusal from my spouse, the agent said they don't have any record on the phone. Even just to find a piece of hope that I did try to update them. I don't have any proof (except if I had a recorder phone). THE END! Really got a shot on my forehead. Never thought... owww... really can't get this reality ... never had plan b in CA ... never been in so deep helpless failure ... c'est ma vie???

Hi badsponsor, my eyes strain to read much informations on these things and I found your story which is exactly the same thing has been happening to me recently....What a joke of life!!!!...even thought how smooth getting my PR and then it played on me....I deeply understand your feeling at that time.....I'm experiencing this hurt... I rrrrrreally would know your update story plssss...what did the CIC do to you after that!!?? did you lose your PR status??? and what would you do???!!.

I applied sponsorship inland so there's no chance for me to apply Immigration Appeal Division-IAD. However, the important thing is how to report the misrepresentation in order to correct it while I'm applying Citizenship.

Anyone have any idea???? someone who's reading this story, pls don't make mistake like us....

Many have made the mistake of getting married during the process and not updating. Some of them at least have had their PR status revoked but not all.

In any case, you can not sponsor your spouse in the future so if immigration lets you keep your PR, your spouse would have to apply for PR on his own. If immigration revokes your PR, you may have a ban from Canada for some time but after that, you could apply for PR again, this time including your spouse.
