Family Class Sponsorship - Outland - Please HELP

Hello, I am getting together the all documentation needed to be sponsored under the spouse or common-law by my partner - Family Class Sponsorship - Outland.

Proof of genuine relationship - (photos,letters,proof of gifts purchase, holidays etc, letters from friends) ;)
We are both living in London, I am Italian and she left Canada when she was 3 years old.
She was born in Montreal, Quebec, but we are looking to move to Toronto.
We have been together for 3 years and we live together under the same address about a year (I moved in with her and her parents before that, I have been living in the same building and renting a room from someone else as I could not live with them, so basically we spend more then two years living together)
We are about to set up a joined account here in London, where to put all our savings for Canada.
She does not have a continuous income as she will probably get a financial help from her parents. However I work full time and we are planning to save more during the application process.
I also contribute in bills and rent at home with her parents.


I have a few questions related to our situation listed below, and I would be really grateful if someone could help: :D
- Are there any "benefits" in regards to the application or its process if the sponsor is from Quebec ?
- Can we move to Canada while the application is still in process ?
- Lets say we will send our application in May 2016, can we potentially move to Canada in September 2016 ?
- Can I work in Canada while my permanent residence application is in process ?

Hi

Have you actually lived together continuously for a year and can prove it?

For your questions:

1. No, being from quebec does not give any benefit.

2. Your partner can move here. You can come as a visitor.

3. See above

4. You will not be able to work on the basis of the PR app. You would need to follow the regular process of finding an employer willing to go through the LMIA and work permit process. Chances of that are very unlikely.

Hi,

Yes we can prove with photos and friends letters, that we have been living together for the whole relationship sharing my place and her place.

- If I come as a Visitor, can I wait in Canada till the process is finished ? and what should I say to the Officer ? (We do not want to separate during the whole process)

- Can I apply for a open work permit at the same time of the outland Sponsorship ? (So I can start to work in the meantime)

Basically we would like to apply from here (London) then move to Canada, live together and work, all this during the process.
In hope that our relationship will look genuine enough to do not require an interview in London as I would be already in Canada. Any chance ?

Photos and letters don't prove common-law. You need mail at the same address in individual or both names, a joint lease (if from her parents, notarized is better), joint credit/bank statements, IDs showing matching addresses, bills in both names etc. Without any actual proofs, you have a very weak case.

1. You can continue to extend your visitor status until the app is approved. You tell the officer that you are visiting your partner while your PR app processes.

2. As I said above, no. You would need a job offer from an employer with an LMIA

3. For visa-exempt applicants with no red flags, the chance of an interview is very low.

We have no bills on our names, its all on her parents.
I just live with her here, and I am participating to pay the bills giving some cash on hand to her father. (nothing official)
We can make a joint account now but is not going to be a year if we open that now.
My bank account is addressed on the same address of her now, which could be a year in few months.
Also we have got proof of purchase (amazon) of gifts we have been receiving from each other on same address, with name and everything.

We basically are moving there together, starting from the bottom. Her parents are not even Canadian, she is the only one born there with Citizenship and Passport.

So if we want to move there and start to work both immediately we need to wait in London till the app is processed ? Right ?

The entire basis of a common-law app is proving to a complete stranger that you have lived together continuously for at least a year. You need to focus on collecting more proofs.

It would not be a lie. Your partner would be moving to Canada. You don't yet have that right, so you would be coming to VISIT YOUR PARTNER, not her friends.

We will collect more proofs of our relation on the same address here in London.
Just to make it clear, Did you understand that she has nobody in Canada, no friend no Family and nobody of her family is Canadian. She will not move to Canada before me and if we come across the boarding together how can I say that I am coming to visit her if I am flying with her and we not have really a place to go yet. We may look for an accommodation once we are there. She was born in Montreal and left the Country at the age of 3 years, thats why she is holding a Canadian Passport.

Yes, I understand. That doesn't matter; she's canadian, so she has the right to move to Canada. You don't, so you are coming as a visitor.

My partner have a Canadian passport but expired few months ago and she is about to apply for a new one.
Can we send the application even if her passport is expired and while the application is in process she will get the passport or she need to get first the new passport and then we should send the all application to Canada ?

Provided she has other proof of her Canadian citizenship, such as a birth certificate, her passport isn't required.

Yes she have a card that is a birth certificate I guess that proof she is Canadian.

Also, I did print the documentation but the barcode that should be generate on the forms is not coming out, its blank. Can I still send it like that or do you know hot to fix that or who should I contact ?
