Failed to fill the BSF5113.Now what?

Hi every one.Wishing you all a great year!

I am a Canadian citizen (by birth) and had been living in Greece for over 35 odd years until I decided to pack it up and move back here.I sold everything and packed my girl's and my personal stuff in cardboard boxes.These are bed sheets,clothes,documents,books,tools,home decorative items,shoes,blankets,pictures etc.All these have no value and are all part of our household and used.I have no electrical appliances and no furniture.They're all used and bought over the course of 15 odd years.

I called CBSA and talked to an agent and she told me that I should have filled the BSF5113 form at the time of my arrival.Something which I did not know at the time.I came in to contact today (7-1-2015) as I just found a place to rent and I have a steady job also,so I was planning to have my items sent to me.The agent told me that there is a possibility that taxes may be applied on my belongings.These are items that have no value and I cannot estimate what value each and every item has at the moment,as I mentioned they have been purchased throughout the course of 15 years and more.

So after talking to her she said that there is nothing that can be done (!) and that I can import my belongings and if there are taxes applied or the amount is high or I cannot pay it,then I would either send them back to Greece or the CBSA would destroy them.

Why is there a time limit that I had to apply the BSF5113 form,the day I arrived?Why is there not an option for a Canadian citizen to import his/her personal belongings even after a short period of time?What differs,that I would have to pay taxes on used personal items now?There was no intention of not declaring them anyway.

It is very difficult for an individual to start his/her life from the beginning and for me,to import my belongings,paying a large amount just to receive them here and for CBSA to presumably charge me taxes (which I cannot assume the amount) and if I cannot pay those taxes,they would destroy (!) my personal belongings?Is it so easy to destroy someone's personal belongings?

What can I do at the moment?What are my options?Should I bring the boxes and sort what is of value (pictures,documents etc) and just let them destroy everything else?She also mentioned that it's up to the officer that would handle my case to imply taxes or not?Is that true?

Is there a possibility, that If I travel back to Greece and come back and upon my arrival at the airport, I fill in the BSF5113 can I bring my belongings afterwards without me having to pay taxes?

I need some help on this....

Sorry.I failed to provide that.I returned on April 23rd 2014.I left when I was 13 in 1981.I don't know under which I comply...

I think that you are out of luck. You can't now submit the required form under the FORMER RESIDENT (tariff item No. 9805.00.00) exemption because you are unable to declare that "I have been continuously absent from Canada for at least one year;" when you submit the form, even if you were to go back to Greece and return. We nearly had the same sort of problem when we returned to settle in Canada.

So what options do I have?Say, that I have my belongings sent here and upon arrival,I open each box up and go through my stuff with the border agent because,seriously,I didn't write down every single object that I put in those boxes.Does he/she calculate how much my items are worth and apply the appropriate taxes?What exactly are these taxes and how to they get implied?How much tax would a used pair of shoes have?A used mattress cover? Our clothes that we wore every day? And I still don't understand the logic in all this....Is this some form of punishment?What makes it differ,that I didn't fill out the form when I landed and for trying to have my personal belongings brought in now?

I suggest you should still walk into the nearest CBSA office and bring that form. On the day of landing which was few years ago, a friend of mine presented the form for CBSA stamping but the officer refused to stamp. Afterwards, he phoned CBSA and an agent told him to bring that form with documents such bill of lading to a CBSA office in Vancouver. He did that and the stamping were done.

It's worth a try but I think that 8 month gap is going to be a problem. A lot may also depend on whether there are any adverse notes on your CBSA file resulting from the current refusal. Good luck...

Sorry but I don't know what that means......what refusal?

Also,under what to apply under?Settler or Resident?

Persons coming to Canada for the purposes of employment for a period exceeding 36 months (other than United States Preclearance personnel) are at first arrival considered to be Settlers to Canada even though they may be considered Temporary Residents for immigration purposes;
I did come for the purpose of employment.

Former Residents of Canada are persons who are returning to Canada to resume residence in Canada after having been residents of another country for a period of not less than one year. Persons who establish themselves as residents of another country for a period of at least one year may make return visits to Canada (as non-resident visitors) without jeopardizing their former resident entitlement.

By refusal, I'm thinking of the conversation that you had with CBSA... You could only qualify as a former resident I believe because you have already been a Canadian resident in the past. There is a partner form for the B4, called the B4a. This is for the overflow page(s). So, 1 x B4 + multiple B4a. You certainly have to provide a value, and where appropriate, a serial number of anything of significant value. Household goods can be lumped together with an approximate valuation. We had nearly a hundred boxes and preparing the B4(a) documents took significant time.

Hello.I tried recalling what I packed 9 months ago and tried through Skype,to get my brother to open the boxes.I cannot provide a real estimate of my used belongings.They are all used....A lot of bed & bath stuff,household decorations,books,etc.Can I provide an estimation of my belongings?What if they rate it a higher value,based on there personal estimation?I can group together all the bed and bath,the kitchen,the decorative things,the books and also I have my toolbox (luggage) and a guitar.Can someone kindly tell me what is the percentage of tax that I will have to pay??I cannot find it anywhere.
