Extension of Work Permit

I applied to cic through an agency to extend my work permit (NOC B JOB - working there for 5 months)but it was refused on the basis that the IMM5802 was not submitted and the compliance fee not paid by employer under the international mobility Program. The agency said there was no basis on submitting that form given that I had a open work permit, but at the same time , it clearly stated in the letter received from CIC that it was refused on that basis. I just don't understand, need ur opinion on this guys. Now my permit is expired and I'm out of status.

So you were only issued part of your PGWP after you finished your studies because your passport was expiring - and now you are trying to obtain the rest of your PGWP? Is that it?

No, I received it from last year but the job I was in was a NOC C, but for the past five months I've been working in a NOC B job when I applied.

Just to make sure I understand you correctly...

Did you complete a 1 year course and where then issued a 1 year PGWP - and now you are trying to extend it?

Yes I did a one year post grad course in Toronto but currently in Saskatchewan where I was working

In that case you can't extend your PGWP (you were issued a 1 year PGWP and have already used it up). What you need to do is apply for a new work permit - but in order to do that, you need an approved LMIA from your employer.

Unless there's a detail you left out, you were correctly refused (and the agency should have known you were going to be refused). Hopefully you stopped working as soon as you received the refusal letter.

No international student dont need LMIA they just have to pay one employer form and employer complaince fee.And they jut need full time permanent job offer letter in NOC o,a,b

The document below is a copy of the letter i received from CIC

Based on your application and accompanying documentation that you have provided, I have
carefully considered all information and I am not satisfied that you meet the requirements of the
Immigration and Refugee Protection Act and Regulations. Your application as requested is
therefore refused.
On February 21, 2015, new Regulations came into effect requiring employers who provide
offers of employment to Labour Market Impact Assessment-exempt foreign nationals in the
International Mobility Program to
 provide their offer of employment directly to Citizenship and Immigration Canada (CIC)
using the form (IMM5802-Offer of Employment) and electronic system provided;
 electronically pay the new employer compliance fee of $230.00.
The employer must provide a copy of this offer of employment form to the foreign national for
inclusion in their work permit application.
As you have not provided the IMM5802 Offer of Employment form and the employer compliance
fee of $230.00 your application has been refused under R200(3)(f.1).



Based on the letter it was not refused on any other basis

Read the thread again. The answer is in the first post. The work permit extension was refused by CIC.

Hi Philo,

Based on my experience; I studied 1 year in Toronto, then I moved to PEI with 1 year PGWP. You cannot apply for PGWP extension OR new work permit extension without: 1. LMIA (support from your current employer which is on NOC A or NOC B) OR 2. PNP Nomination certificate from your current province.

My question: why don't you applied for Saskatchewan PNP when your work there in NOC B for 5 months? Very important thing: to apply PNP, your job should be related with your PGWP. If not, even in NOC B you will not eligible to apply.

I can say this, because I did it all. Now I am PR on process.

my advice; find the employer who wants to provide you with LMIA.
