Hi,

Help!!!!!

I want to clarify if Temporary Resident Visa is also referred as Visitor Visa?

I have a visa (sticker... is this Temporary Resident Visa??) in my passport expiring on 25th March 2014, my entry into Canada was on 5th June 2013. Therefore, my entry stamp for 6 months stay is expiring on 4th December 2013. I've submitted my application to extend my stay in Canada as a visitor and paid $75. Now, is this application for my entry stamp extension or for the Temporary Resident Visa or both? Or do I actually have to leave the country?

Do I need to apply for another Temporary Resident Visa (expiry date 25th March 2013) or can it be extended?

By the way, I've also submitted my application for Permanent Residence status which they received on 25th July 2013.

I am not sure what to do here, am doing it correctly or incorrectly? ??? It is confusing and tedious...too many applications. Is there any way to simplify these? :(

1 - Yes TRV is the same as a visitor visa.

2 - Yes the sticker is the TRV.

3 - The application is for extension in stay, not visa

4 - You don't have to leave the country until you get a response about the extension application. If you don't have a response before 4th December, you'll be what's called an "Implied status" and you'll be completely legal to live here.

5 - As far as visa is concerned, you cannot extend a visa. Once a visa is expired, you can apply for a new one.

Hi

Looking at your previous posts, you have applied for PR inland. Did you submit an Open Work Permit application along with your inland PR app?

Really? My kids are here, my daughter is in elementary school and husband is working. I am caregiver to my kids. I have my PR application submitted in Canada. How possible can I obtain it here? can I do it online?... I read somewhere in the website that I can obtain another TRV here. Any other option? Please help.

No, I did not. What is Open Work Permit? Does it help me to stay longer here while waiting for my PR to be approved?

It's exactly as it says, a work permit without employer restrictions.

Submitting an OWP app with an inland PR app gives Implied Status, allowing a person to stay in Canada throughout the processing. After Stage 1 approval, the applicant can work.

I advise you to send the OWP app ASAP. The application is here http://www.cic.gc.ca/english/information/applications/extend-worker.asp. Write a letter explaining that you have submitted an inland PR app but were unaware you could send the OWP app with it. Across the top of IMM5710, write "OWP to process after Inland PR app".

If you can get the OWP app submitted within the next few days, you should try to withdraw your visitor extension and get a refund of the fee, as it will be unnecessary.

You didn't state the statuses of your children. If they are here as visitors as well, you do need to continue extending their status as visitors.

Thanks for the advice... :) According to the website the extension fee is non-refundable....??? Can it actually be refunded? How to withdraw it, any contact via email or phone call? If I obtained OWP how long is the permit valid for? You mentioned Implied Status...is it until I hear decision from the immigration?

My husband and my two children are Canuck (Canadian). My daughter is 6 yrs old & my son is 4 yrs old. As a fulltime mother/caregiver I need to be here all the time. My daughter started school this year. Awww...headache!!

If they haven't started processing the extension, they may refund the fee. http://www.cic.gc.ca/english/helpcentre/answer.asp?q=613&t=4

The OWP will be valid until you get a decision on PR. Implied Status will cover you from expiry of your current status until you get the OWP.

A TRV allows you to enter Canada. Once you are in Canada, you don't need to apply for another one unless you are planning on leaving the country for a while and coming back. As you have applied inland, it is recommended that you do not leave, so you won't need a new TRV

On the TRV issue...how can I not apply another as it will expire on 25th March 2014, and still remain in Canada? Sorry I am confuse and I want to do it right; I don't want to overlook and get into trouble with the law. Don't I need something in my passport stating my valid status to stay here? By the way, Alberta Health will not cover me unless I have a valid visa or PR confirmation. I don't think the OWP will work...will it?

It doesn't matter if it expires once you are in Canada, provided you maintain your status. There are many visitors, workers and students in Canada who have expired TRVs or entered on single entry TRVs that are no longer valid; they can continue to extend their status in Canada without needing another TRV.

You need to MAINTAIN YOUR STATUS. This is done by submitting the OWP app, giving you Implied Status and allowing you to legally stay in Canada. You don't need to have anything in your passport stating that.

I've looked into Alberta Health website, stated it does not cover for 'implied status'. It has be active visa, work permit, study permit or PR confirmation status.

I need to figure how am going to work around this....

There have been several people on the forum who have managed to get coverage in Alberta while waiting for PR. I googled it and the website also says:

AHCIP eligibility while waiting for permanent residency status

In order to be eligible for AHCIP coverage you must have a valid Canada entry document or a letter from CIC indicating a “positive first decision” has been made regarding your application for permanent residency.

If you receive a “positive first decision” letter from CIC with respect to your permanent residency application, forward a copy of the document along with your completed application for AHCIP coverage and other required documentation to Alberta Health.

Your AHCIP coverage may be reinstated to the date of the “positive first decision” letter but not earlier.

If your Canada entry document is due to expire and you have not yet received this letter, you may be eligible for a one time only temporary extension of your AHCIP coverage. However, we recommend you apply for an extension of your prior permit during the waiting period to avoid a lapse of coverage
