Extending my stay as a visitor while waiting for pr information

Hello,
I'm hoping for some help please. I am from the States and have been in Canada for almost a year. About 7 months ago, I requested a visitor's extension to establish common-law status with my boyfriend and so I am here legally until July 1. When I came up from the States last year I brought an FBI criminal check with me because we had planned on my filing for permanent residency after we became common-law. Now that we are finally common-law (or will be in a month), we are gathering the rest of the documentation together. To my dismay, I discovered that my FBI criminal check was only good for three months and I'll need to get a new one, but now the times for receiving one have stretched to three months! My visitor status expires July 1. We have most the paperwork completed, but can't submit it until we have the criminal check. I know I will need to apply for a visitor's extension, but don't know the best way to explain my situation if I apply online. I'm stressing about being refused. Also, I've read several different things about the medical exam requirement. I haven't had a medical exam. Will I need one if I'm from the US and apply inland? Thanks for any help you can provide!

Yes - you will need a medical exam (everyone needs a medical exam). You should really consider applying outland instead of inland. You will likely end up hating life if you apply inland.

You can submit the application without the PCC and send the PCC later.

I didn't realize we could send the application piece-meal! Thank you for the tip! And I will truly consider applying outland rather than inland. I know it's faster and I can't take the stress!

for extending visitor visa online you do not need criminal check, so you can still apply the visa extension, however you will need to provide it when you apply PR as common-law partner, also after you apply the visa extension, you'll be in implied status which means even your visitor visa expires prior to the result comes out, you are allow to stay in Canada, but if unfortunately your application is denied, you have 30 days to leave the country.

For visitor visa extension, you'll need a camera or scanner to make it to one file to upload it online, I'd suggest you use a scanner.

PCCS are an exception because CIC knows they can take several months to be issued (especially from the FBI) and they aren't required until stage 2. Everything else needs to be included. Make sure to include a letter of explanation for the FBI cert.

And as scylla said, go outland.

Definitely go outland as an American. 6-10 months and boom, done. Inland? Two years+ wait. Sure you can get an OWP... In 6-8 months.

My question is, with the TRV are you allow to leave the country? It says on the paper this document doesn't assured the re-entry to the country. But I just want to know if it's true.

If your visitor record is not a multiple entry record then yes, leaving Canada will make the document void, and on your return to Canada you will be issued a new visitor record (assuming CIC lets you in).

Your visa is not expiring. Your visitor status is expiring and this is what you have applied to extend.

You can leave the country whenever your want. Re-entry is never guaranteed, regardless of having a valid TRV or a PR app submitted.

A TRV is an entry visa; it allows a person to board a commercial carrier to travel to Canada. It does not allow give status in Canada; that is entirely dependent on the CBSA officer.

If you leave the country while your visitor extension is processing, it is essentially void. The app is based on you remaining in Canada.

A visitor record is not a TRV and has nothing to do with entry. A VR is a way for CBSA to more strictly control a person's visitor status.

Thank you, everyone, for your responses. Per your suggestions, I will definitely apply Outland. In the meantime, I will need to request an extension to stay while we finish the rest of the paperwork. Turns out there are also some issues regarding his divorce paperwork that must be resolved (sigh). What is the best way to assure them that we are serious about filing for permanent residency, but simply need another three months? Will a simple explanation that we "require additional time to complete pr paperwork" be sufficient?

Pay the $1040 PR fees now and include the receipt in the extension app. Just say that you are getting the app together, waiting on some documents, and will be applying soon.

You will get your OWP by the time your status expires, most likely. It's not necessary to send the extension status 30 days in advance. If your status expires Dec 24, you need to send in the extension request by that day and yes, it gives implied status.

You can easily wait til late Dec and, honestly, even if you don't get the OWP by then, I've never seen a case of an OWP application returned past two - two and a half months, not to mention four.
