Extend post-grad work permit while applying for permanent residency

Hi guys just looking for the answers to a couple questions.

My common law partner is on a post grad work visa right now that expires June 18/2013. We are going to apply for her permanent resident card through family class sponsorship in the next month.

My questions was if I send an application to extend her current work permit can she continue to work under implied status until she gets an answer from the CIC?

If I understand it correctly if we successfully pass Stage 1 for the immigration process she is entitled to an open work permit, I'm just not sure if she can continue to work until Stage 1 is successfully achieved or does she have to quit her job and wait for the stage to be completed and then work again...

So if we send an extension for the WP at the same time as the PR card, they will separate the two applications and process the WP on it’s own?

Post graduate work permits are non-extendable. If she wants to keep working past the expiry of her PGWP (and before her open work permit is approved), her employer will need to obtain an approved LMO and she will have to apply for a closed work permit.

PGWP can be extended if the longest entitled period shown on WP has not used, eg. PGWP has notes saying 3 yrs, but was issued for 1 yr due to passport expiry date.

Ok thanks Scylla.

So she will have to stop working when it expires on June 18th. But she can submit an open work permit with her permanent residence (through family class sponsorship) application, and if/once Stage 1 is approved she should be able to continue to work again on the new open work permit?

GUys according to a new rule released Dec 15th, If you are "IN CANADA" and if you have an OPEN WRK PRMT, and if YOU HAVE APPLIED FOR PR and have RECEIVED AN AOR (atleast) for the PR Application and if your WP is expiring within the 4 months, you can apply for an extention of your current open work permit. You dont need a LMO to do that. Please go through the CIC website. SO its good news for all or most of us guys. You can extend you rwp for a year if you awaiting a reply for your PR application and if you have received an AOR and if you are in Canada and if your current wp expires in 4 months.

^^ We are going to apply for PR within the next 2 weeks. Say January 15th. Her open work permit (via post-graduate) expires June 18th. We're going to send an application to extend/change work permit status with the PR application at the same time. I just wasn't sure if she could work past June 18th or not.

But also, if we apply for her PR 6 months prior to her work permit expiring, there is a chance we could receive approval of Stage 1, and then receive a new open work permit ( I think this is correct, I got this info from the family sponsorship thread).

So should I send the work permit extension WITH my PR application, or should I send it after I receive on AOR on PR application?

Also does anybody know if I receive approval of Stage 1 PR process, then I can receive an open permit correct? If so, do I have to send out a WP application after Stage 1, or should I send it out now with PR application so I get a WP as soon as Stage 1 passes.

To be eligible to extend your WP, you should have received atleast an AOR. Please rmbr that extention of your wp under this particular class depends on your PR applucation and its status. Which means that they are allowing you to stay back untill a decision has been made on your PR app. So please apply for your PR asap and once you get the AOR (hopefully you will get the AOR within the 4 months of your current wp expiring)please apply for the wp extention, In other words you are telling them that you are awaiting decision on your PR app (as proof you attach your AOR number) and asking them to let you stay and work in Canada till the decision has been made.
