Express entry with common law partner

Hello everyone,
I have some confusion about express entry. I just got my lmia approval which can give me 600 points for express entry. But i wanna create profile with my common law partner. Regarding this, i have some questions,
1. My partner's work permit is going to expire on 12 april 2016. So if her permit is expired or going to expire, can i still submit my express entry with common law?
2. If yes , than is there any risk?
3. Can she stay here after her permit expiration ?
4. What are the documents required for common law?
Please guide me for a proper solution.

1. Yes, you have to include your partner always.

2. Yes, if your partner is out of status in Canada

3. NO, except applying before WP expires for a new WP/visitor status.

If you have a valid WP or will apply for using LMIA you should apply simultaneously, or when received, for SOWP.


4. Just a common law declaration form, signed with a Notary, plus some documents like Taxes common law declaration, together bank accounts, insurance, car, home rental...

it is a fully legal status, so i dont think it would cause any issues...

As said it's a legal status, no problems.

You always have to add your dependants in your application, if someone is not accompanying you, you have to explain why. If some dependant have not legal status here, that could be an issue, but is not your case.

You would include her in your application even if her status in Canada was illegal.

For spouse/partners more than 2 years cohabitation is convenient to avoid some complications.
