In my case, i live in USA and my wife lives in Canada on PR status. I am applying FSW on CIC site where i m mentioning that my wife is already there in Canada on PR and she is not coming with me while applying my PR through FSW.
Does CIC count my wife points (like her education, IELTS Score, Canada work experience and foreign work experience points) for my FSW points (Express entry) ?
while filling FSW profile online, i can not see spouse points here after submitting profile.
can anyone suggest me here? how can i make this points countable for my file so i can get more enough points for express entry program file.

one more question came up to me while filling profile is as follow,
"will this person accompany you to Canada?"
what should i fill for this above point in my case? yes or no?

Thanks,
DK

Since she's already in Canada, she will not accompany you.

You do not get points for your spouse, because she is not accompanying you.

No, since your wife is not accompanying you. But if you look at how points are distrubuted, single persons earn more points for the same experience than married persons. You are not "losing" points; in fact, many married applicants earn fewer points with their spouse than they would if they were single.

You will have to find a way to increase your score on your own merits. Or consider family class sponsorship.

You should answer "no" - the question means, is she going to immigrate with you? Since she is already a PR, the answer is no.

What? Common sense would tell you that you should get more points if your spouse is PR. Otherwise, it is so wrong! Is this a family reunion?

No, you shouldn't.
The points system is used to calculate attributes that will be of benefit to Canada. OP's spouse's assets have already been calculated, and she's already received points for them; that's why she already has PR.

The EE system is for people trying to get to Canada on their own merits. If you want to get to Canada based on the fact that you have a Canadian spouse, that's what the spousal sponsorship program is for.

There you go, you should tell him that Spousal Sponsorship Program or what is better for him.
Common sense is if you don't do anything against the laws (US, CAN), you should not be seperated from your spouse! That is more than immigration law, it is international moral obligation. So, by all means, CAN should allow him to enter to reunite with his wife as soon as possible.

You have an amazingly rose-tinted view of the world.

Thank you, istari!
I say this because it relates to big issues like your children, your family members. Think about it, many cases that they filed their application alone, right? Then 5,6 years later, they get reunion with their kids. Is this right to you?
I know any system is not perfect, so they need to improve instantly. Even CIC is proposing to change (currently in Family Class, Siblings...). Did I say something out of the blue?
USA, Australia, European countries made it fast for couples to immigrate in reunion. What is so fancy about this?
@Dk26: If I was you, I would find out more about options. Of course, a lawyer is the best way but it depends on your decision.

Here, for a fact, please read this article: "Spousal Immigration Processing Times Cause Frustration". This forum does not allow to post link.

At the mid point of the article, they made comparison with CAN. Just so you all know I am speaking reality.
Quoted from the article:
"Is Canada Any Better?

The short answer is no, it’s even worse. If you think 10 to 12 months is a long time to wait from your spouse to be approved, try waiting two years, as an internal spousal sponsorship case in Canada will take 25 months to process.

Recently, the Canadian Minister of Citizenship and Immigration announced a new program to enable a foreign spouses awaiting approval inside Canada to apply for a work permit. According to the announcement, processing of the work permits should take about four months. Yet there are complications related to this process for many spouses, to the point where some of them can’t work for a year and a half.

Work permits aside, if you look at “normal” processing times for foreign spouses just to come to Canada, the processing time is easily going to be a year and in some cases such as London, Los Angeles, Mexico or Pakistan up to three years. Can you imagine waiting three years for your spouse to join you in Canada? Clearly this needs to be improved."

It may be a frustrating system, but the fact is that unless OP or OP's spouse were refugees, no one forced them to take the path they did.
OP's spouse chose to migrate to Canada, knowing that it would separate her from her spouse, at least temporarily.

Either OP and his spouse looked at all the factors and decided that being separated for a few years was acceptable, or they didn't think about it properly before deciding.
Either way, this situation is of their own making.

Correct; you cannot get points for your spouse.
