Express Entry PR about to be issued, last minute hitch..please advise

Dear Friends

I came on work permit (intra company transfer)to Canada in early 2014 along with my wife. We didnt have any children.In Oct of 2014 she returned back to India as we decided to stay separate, we have been separated since then.

My employer had hired a lawyer to process my express entry, invitation received application submitted in August . My lawyer has informed me that CIC has asked for a seperation agreement/divorce document.My divorce process is yet to start, we have been discussing mutual divorce financial terms. My ex is not cooperating and the deadline given by CIC is end on November.

My question to experienced members here is if I am not able to get the document before due date, what happens to my PR. I still have a year more in my Work permit, so I can live and work in Canada. But can I reapply for PR again or the same file will be reopened when I get the document in future.

Is this a ground for refusing PR or they will put my file on hold.

My opinions are below: (lets see what seniors say)

1) Is your EE profile includes your wife as well? If not, its possible to file as a single person. I think CIC is not bothered if you are filing alone - please check this
2) If the no 1 is not possible, convince your wife for this process.
3) If no 2 is also not possible, you can apply later or re-file profile again. But i think discuss with your lawyer and do appropriate.

did you checked with your lawyer, whether it need to show separate as its not legally yet?
Also if you dont show separate and applying as single will cause any issue or any documents required for that?
