I'm hoping you can help me with something. I have been invited to apply for Express Entry under the CEC programme.
I worked in Canada under NOC Skill type 0 for over a year legally on an IEC visa.
Due to family reasons I had to return before my visa ended (There was 2 weeks left on it) and my Canadian job held the post open for me. They had since hired an immigration consultant. The consultant informed me that I could either :
A - come back before the visa ended and then they would apply for an LMIA for me.
B - Stay in Ireland and apply for PR and then come back.
I went with option A and explained absolutely everything at the border.
I was working for them for 5 months after my permit expired in which the consultant constantly re assured me that there was delays with immigration Canada and that it would be sorted soon and that I was under implied status.
Eventually I had enough of waiting and no correspondence so I went to the border with the consultant to apply for a new work permit.
I left Canada to flagpole via a US land border and tried to apply at the Canadian border. I explained absolutely everything to them in full truthfully.
They then informed me that I was working illegally as I had no status in Canada for those months (they lambasted the consultant as they were with me, and the consultant tried to argue that they were wrong.)
Anyway, I was issued with an "Allowed to Leave Canada" document and given 2 weeks to pack my things and move back to my own country.
I was informed that I had to stay outside Canada for 6 months and that I could apply for PR then and that it won't affect me
I have noted on my EE CEC application that I had over a year of Canadian experience under NOC skill level 0 and acknowledged that the other 5 months were worked without the proper authorization.
So, after that, I have 2 questions as I am a little worried :
- Should I explain my entire story on the letter of additional information?
- Will I have any issues when applying for my PR because of this?
Please bear in mind that I did not lie at all during any interaction with any application or throughout the entire process and I have never had a criminal conviction for anything.
