Express entry CEC application refused

Hi everyone,

I applied under express entry and got selected under CEC stream.I studied and worked in ALBERTA. I work as an Assistant manager in Retail NOC 0621 and was working as a supervisor before. Combined with my supervisor experience it gave me 2 years experience in Canada. I also claimed foreign work experience for a year in India as technical administration. I got my AOR on Jan 11th 2020 and got the refusal letter today June 18 2020.

I turned 18th in 2014 and worked part time with my school and full time hours in summer before coming as a student here in 2015.

Immigration sent me a message asking for explanation about me working as on my student application in 2015 which was filled my agent, the mentioned only my school and IELTS in 2014-2015 but no work experience. I had a reference letter from my employer in india and got it signed and attested.

I got refused today and I got this reply.

"I am not satisfied that you meet the skilled work experience requirement(s) because I am not satisfied that you have the foreign work experienced claimed. I have read your explanation regarding the discrepancy between stated activities in this application and from a previous application and from my assessment the balance of probabilities strongly indicates that you have not fulfilled the amount of foreign work at the stated NOC level as claimed. As such, you have insufficient points to pass this campaign."

My post graduate work permit expires in January 2021.
No agent or consultant is giving me straight advice here in Edmonton and they are all scaring me and asking for so much money for no reason.
I am wondering if I should apply for AINP and put a paper based federal file and wait calmly OR if i can apply for express entry again IF I CAN without claiming foreign work as I will be getting more points in November for completing another year of work here in Canada. Some agents also suggested if i make an express entry profile I will be picked by Alberta Express entry stream.
I know I can apply for AINP and express entry and see which way to go through. I am just really worried as my work permit is expiring soon and I want to do it the right and secure way. Please advise! Thank you.

You got refused for a discrepancy between your previous and the current application.

The fact that an agent filled the application for you will not exempt you of any responsibility. Anyway, this refusal means that you will likely never be able to claims that foreign experience time (and you must actually check that experience you have can actually be counted as foreign experience). Or at least you will have a hard time convincing another officer that your claimed experience actually exists.

Yes, to make things easier since you studied and work in AB you can just claim the Canadian experience, but again if your level of education /language exams, etc. are not high enough you might not get enough points.

I don't see the problem to waiting until November to earn additional points for work experience since you will be able to get a BOWP right away and continue to work past your PGWP expiration date. Why would this scare you?

It is strongly recommended to mention all kinds of work experience when you apply for student permit as you might need to take advantage in future. You can apply for PNP program and don’t consider your foreign experience in future to avoid refusal.

Thank you. Yes I am fully aware of getting the agent filling my application and being fully responsible for my file. Are you suggesting I should remove my foreign work experience when I make a new profile? Is there a way I can mention the foreign work experience perhaps in letter of explanation or personal history just to be safe but no intent to claim points for it or do not mention it all?

Also I realized for 2 years of my work for one year my agent put me as NOC 6211 as manager of duty which falls under C category as i was assistant manager in training and the other year when I was promoted as assistant manager as NOC 0621 which is under 0 category.
Do I change the NOC of first year to NOC 0621? I can get my employer to confirm this since first year we are trained under them and then given the title. Or is changing the NOC a bad idea?
Please advise. I really appreciate it.

You shouldn’t claim points for foreign experience for which you got refusal. You can’t mess up NOC’s and just apply with multi NOC. Don’t repeat your mistake by change your NOC. As long as your NOC falls under A,O,B. You should be fine.

Apply again, don't claim thay foreign experience. You should have enough points to get invited. You should mention that experience in your work history. But if you don't claim points for that work, u don't have to prove. Do it as soon as possible.

Don't put it in your work history, all experience in your work history will count towards your points total, and you have to provide documentation for it.

Put it in your personal history.
