I have read several IMEDA learning moments that dealt with the Canadian Experience Class program of Express Entry. Most of the reader's questions deal with the definition of what is a qualifying job offer in order to get 50 points on Express Entry and whether different NOC codes or multiple jobs qualified to meet the 12 month continuous employment requirement.
My question, which I believe has not been asked as yet, is whether work experience gained on an open IEC work permit (working holiday visa) will be considered as qualifying work experience to meet the eligibility requirements of the Canadian Experience Class program if it is full time skilled work experience in NOC 0, A or B? Let's assume that the full 12 months were gained within the last 3 years. Also, would the client receive commensurate CRS points for 12 month of work experience obtained while working on a legal open work permit?
I am dually confused due to some case law I read before where an individual was refused PR because their work experience gained as a store supervisor on IEC was deemed not qualified under the program. Is there a distinction between FSW and CEC program on their acceptance of experience obtained on an LMIA-exempt work permit?
