Expiring TRV tied to work permit - can I come back to CND with European passport

Hi all,

I currently have a Temporary Work Permit valid until Feb/2015. It is tied to my Brazilian passport. However, my TRV expires Sept 30th this year.

We already did the medical exams for the FSW and should be getting the PR visa anytime soon (Brazilian consulate is saying just a few more weeks), just not sure it will be before Sept 30th.

I recently got dual citizenship from a visa-exempt country. My question is: in case I need to leave Canada in the "limbo" time between my current TRV expiring and my PR being issue, would I be able to re-enter Canada using my European passport (even though my work permit is tied to my Brazilian passport)?

Googled it and could not find an answer. I am really don't want to apply (and pay for) another TRV if I am getting the PR soon. I don't have any travel plans, but a emergency may arise.

Pragmatically, yes you would be able to enter on your EU passport. HOWEVER, if the BSO asks you "what is your status in Canada" and you say "worker" he's going to want to see your work permit, which will be in your OTHER passport. What's most likely is that giving them both passports will be OK with them, but it will probably earn you a visit to the secondary inspection line.

But this sounds like quite a hypothetical - if you don't need to leave Canada, why worry about it at all? Otherwise, getting it is a bit like buying insurance - $150 (multi-entry TRV) against the chance you don't need to use it.

Further, you will be fine as long as you only go to the US:

Foreign nationals who require a temporary resident visa and who seek to re-enter Canada must
be in possession of a multiple-entry temporary resident visa unless:
...
they have only visited the U.S. or St. Pierre and Miquelon and they are in possession of a
valid visitor record work permit, study permit, or a temporary resident permit (authorizing reentry)
and are returning within the initial period authorized by a BSO, [R190(3)(f)];

I would suggest looking at this manual, as this is the guide used by CBSA at the port of entry to evaluate cases such as you suggest. My best guess (for what little it is worth) is that the Secondary BSO will likely allow you into Canada - you have a visa exempt passport, you have a work permit. They may submit a report that you have multiple passports, but that's not a terribly unusual situation.

Hopefully, your visa office will wrap things up before you even need to leave Canada.

This visa office needs to get things in order and get all these PR visas issued once and for all!
