Expiring PGWP: Thinking of completing one year work in India and apply again

Hi guys,

I could really use some help here. My PGWP will be expiring soon (Oct 2016) and I will have almost 3 years Canadian work experience by then.

Note: Almost 3 years which means 2 years, 11 months and few days.


Currently living in Ontario (Brampton) for almost 5 years.

Sitting on CRS 447 and have exhausted all resources to boost CRS score (Max education points - 2 yrs Canadian Diploma and Max IELTS score - CLB 10 in all)

I won't be able to complete full 3 years of work experience (may be I would, not sure about the implied status thing....) which will boost my score to 458 (given full 3 years Canadian work exp.) . But anyways, Lets assume that I can't finish my 3 years work experience in Canada and have to leave the country towards to the end of my 3 yrs work experience.

Main Question: Would I be able to apply from India (after a year experience in my own field - Outside Canada)?? And If I did apply, Would I get points for this 2 years 11 months work experience in Canada?

Please assist, thanks......

I am assuming that you would want to qualify for CEC.

have at least 12 months of full-time (or an equal amount in part-time) skilled work experience in Canada in the three years before you apply

That means that only any experience within the last 3 years is counted towards your Canadian work experience for CEC. So if you leave the country and spend 1 year abroad, your eligible Canadian experience for CEC will be down to 1 year and 11 months.

Thanks for the prompt reply.

But I'm a little confused here. So Lets say I leave Canada after completing 2 yrs 11 months work and start working in India and complete 1 year work experience there.

At that point If I decided to apply in Express Entry (CEC), Would I be eligible to get points for the following:

Work experience in Canada (2 years from the time I left the country - Options are 1 yr, 2yr, 3yr and so on)
Work experience outside Canada (1 year)

Please help....

Actually you can complete your 3 years in canada, Here is what you can do.

1. when your PGWP is about to expire in October, apply for extension of work permit. It be take around 90 days usually for them to process. During this tenure, you will be in implied status and can legally work and claim experience.

2. when they process your Work permit application, they will reject your file saying they cannot extend PGWP, which is fine as you will get your required experience.

3. After your rejection, you will have 90 days to take action, if you want you can go back to india, or wait till the end of 90 days, apply for visitors visa. NOTE: you CANNOT WORK in these 90 days or in visitors visa.

4. You always have an option to go back to India, work there for a year and add that experience to boost your score, YOU WILL STILL BE ELIGIBLE TO APPLY UNDER CEC CATEGORY. You can claim points for 2 years 11 months or 3 years if you do what I advised and 1 year experience from India, which in total will be 4 years experience.

hope this helps.
Under which ground he will apply for extension? If purposefully he submits an application which he knows is going to be rejected, wont it amount to fraud? I believe its better to play straight rather than having a visa rejection (which he would have to disclose during PR application) and risking future applications.

Otherwise how anyone can get points for 4 years and more (it cant be within last 3 years)

nothing as such and no, it's not a fraud. It's a genuine application process which is aided by the cic, type in 'extension of stay in canada' in google, read the entire page... you will know.
