Expired Pr card- need to sponsor husband and child

Leon, I have been reading your comments for a while. I am in a dilemma. I got my PR card in DEc 2006. I stayed here till Feb 2008 and then got married and moved to England (My husband is a British citizen). I stayed there and got a british citizenship and last year decided that we want to raise our daughter in Canada. Me and my daughter moved here in November. I have just found a good job and live with my parents. My husband has been travelling back and forth to wrap up his business and has been here for two months. Since I haven't met my residency requirements and have an expired PR card. I cannot apply to renew my card nor sponsor my spouse or my daughter who was born in England and is now 4 and a half. My husband just sits at home and feels depressed as he cannot work here and it will take almost two years before they get PR status. He is thinking of doing a business under my name or something. Meanwhile, my daughter is going to a private school which is very expensive as they said that I need a proof of her sponsorship application- is that true? Can you give me some advice plz?

I can understand that this is quite an unpleasant situation.

You're correct that you need to wait until at least November 2014 before applying to sponsor your daughter or husband. You shouldn't apply for a PR card or leave the country before you meet the residency requirement again. Doing any of these things could result in an investigation concerning your own PR status.

May I ask what province you live in? Also, what is your husband's profession?

I'd also be curious to know what your experience was like at the border when you re-entered Canada in November.

You are right that you have to wait to sponsor your husband and daughter until you meet the residency obligation. That is the price you pay for not meeting them.

Your husband and daughter need to stay legal if they want to be in Canada so they can actually not stay more than 6 months without applying to extend their visit visas. You also need some kind of health insurance for them in case something happens.

Enrollment in school for a child on visitor status depends on the school district. Sometimes PR's have been allowed to enroll their non-PR children without a problem and sometimes not. The school could actually require you to get a study permit for your child and to pay international student fees if they wanted to which may not be cheaper than the private school you have her at now.

Your husband could get a work permit if he finds an employer who wants to apply for a labour market opinion for him. Same if he is eligible for a working holiday visa, he could get an open permit for a year or two.

To add to the great advice you have already been given...

Whatever you do, do not let your husband do business under your name. If he's caught - he could be deported which will make your situation even more complicated that it is today. If he wants to work, he should try to find an employer who is willing to offer him a job and can obtain an approved LMO.

I have resided in Canada only for 21 months in 5 Years and my wife has stayed only 1 month. We both are in Canada but both our PR cards are expired. Our son is here with us on a TRV. I would like to know if I can sponsor my son for PR or should i apply for his visitor record now and wait to sponsor him until I meet my residency obligation and renew my PR card.

You need to wait until you meet the RO to sponsor him.
