expiration of work permit

My work permit will expire in 2 months. They said that after a work permit expires I'll still have 90 legal days to stay in Canada. I just wanna know if it's true and if I still have to apply for this. Thanks and hope to here your insights soon....

You have a 90 day grace period to apply for a restoration of status after it expires. It's not really like you have 90 legal days.

Are you and your employer applying to get your work permit extended? If that is a yes, you would be under implied status until you hear about the results and can continue to work.

If no and you still want to stay in Canada, you should apply to change your status to visitor as of the time your work permit expires. You should apply for this 30 days before your work permit expires but because it takes them 2 months to process, you will not hear from them right away so you have implied status again until you do. As a visitor, you would not be allowed to work so you would have to stop working on your last work permit day.

My work permit will expire on October... i've been applying for a lmo but couldn't get myself approved.... It's been 6 months that im unemployed... Though an employer s trying to get me an lmo... So i just wanna ask, since im waiting for a new lmo which will hopefully have a result by d end of September and if god willing i still hav to apply for a work permit which i think by d time im getting a new one my current wp expires, do i still need to apply for that visitor visa??? And knowing the uncertaintiea do i need to apply for that visitor visa?

If by October you still do not have the result for the new LMO, apply to change your status from worker to visitor. Cite waiting for LMO and WP as the reason for changing/extending your stay. May or may not be approved but you will be on implied status until you get the response. Do make sure that CPC-V received your application before the expiry or your current status, otherwise it would restoration you should be filing.

So I just found out that the employer hasn't applied for my LMO yet, I'm hoping though that he's gonna do it anytime this week or asap.... Considering all the timelines for getting an LMO as well as the new work permit, how would you advise me now? Do u think I should apply for a visitor visa now or should I need to have an LMO first? Or do u think I should just apply for the restoration of my status after I get a positive LMO?

I hope you can help me figure this out....

Usually takes from 2 to 6 weeks to apply for the LMO, that is after the employer has done the mandatory job advertisement which is 14 days with the job bank and another major daily or website, so roughly 2 months. Has the ad been done? S/he will need to attach a copy of the job ad and send a copy of the result of the recruitment effort; s/he can then send the LMO application. Have you signed a contract with the employer? If you had been out of job for 6 months and there's no LMO application in progress you can change your status from worker to visitor (buys you time but may or may not be approved). Your best bet would be to know for sure that a LMO has been applied for before you send in your application to extend/change your stay/status.

Thanks for the insights...

The job advertisement is done, been posted a month ago. Though i haven't signed a contract yet. I'm still waiting for the call. It's frustrating to know that my wp is expiring on d 17th of October and the employer is delaying d processing. I used to have several job offers but i chose this only to find out that my employer is not giving me much importance. So how would u advise me now???? Please i need help... Thanks...

One more thing... When u said restoration, what does that mean? Restoring my status as a worker? Or restoring a status here in Canada either visitor or worker? Sorry just confused...
