Experts plz help. My Canadian husband is unwilling to provide docs/info for my EE file. What to do?

While creating my express entry profile I showed myself as married to a canadian citizen. Now as I need my husband's documents for PR file submission and I know i will not get them,
What documents do I need to submit with my PR file to show us as legally separated?

Are there chances that they will reject my file?

You are married as per Canadian law. If he marries someone else before divorcing you, he will be committing bigamy, which is illegal in Canada.

As he lives in Canada, you can file for divorce in Canada. You will need to hire a divorce lawyer here to act on your behalf but it will be far easier and faster than divorcing in India.

There is no need to see a lawyer about separation, as you are already considered legally separated. Canada does not have a formal legal separation process.

The easiest way to exclude him from your application is to file for divorce.

Could she file independently given that she's legally separated? Just curious..
Many people have been successful doing that. However, others have still been requested to submit their spouse's documents. Showing that she has filed for divorce will make it easier to exclude her spouse.

Hello,
Can you please advice. I have submitted my application on 26th may with a LOE mentioning reason for not being able to submit my canadian spouse's document. I have passed medical on 6th June.

I just called CIC and agent told me that i have met eligibility and background checks have not started. When i asked him about VO, he said file is still in case processing centre.

What is the next process after eligibility and at what stage they send application to VO?

Also, Does eligibility met means application is complete and they are satisfied with all the documents and don't need any additional documents?
