Experts - Please comment - A scenario

Hi,

I am an Intra Company Transferee (from India) working for a financial company in Canada on a closed work permit. I applied for PR under CEC category. Details as follows:
Kindly add my following details

Cateory: CEC
Application Filed: 07/01/2014
Application Received : 07/03/2014
AOR received: 08/21/2014

Situation: I don't know if this is an unique sitiuation. I would like to believe there are others like me. It is in my best interest not to disclose about my PR to my employer. It 'may' lead to my re-assignment back to India sooner than later (you never know). Consider an hypothecial scenario - I will most likely stay in Canada until end of Dec 2015 (as agreed with my employer and based on my validity of my work permit). If all goes well, and if I get my CPR / PR confirmation (say in 13 months time frame), I should have something around Q2 2015.

My question: If I dont do the landing, will my employer ever come to know about my PR confirmation? Lets say, I get my CPR in June 2015, Can I continue to work under the existing closed WP? Will my employer ever get to know? My plan is to go back to India, explain the situation to my employer and most likely quit and then immigrate to Canada for a new employment.

Alternatively, Can I land and decide not to apply for a new SIN, inorder to continue to work as is? My understanding is that whenever I apply for a new SIN, i am obligated to inform my employer, is that the case with PR too? Someone told me that my work permit becomes null / void as soon as one obtains PR. Can someone comment on this?

Are there other possible options to do what I want to do? (i.e. work under closed WP and go back to India, quit and come back). Needless to say, I want to leave my employer on a good note, so I am willing to do what it takes without compromising my PR aspiration.

Has anyone been thru this? Experts, please comment. Appreciate your time.

You can continue working on your work permit and your old SIN if you do not complete your landing, till your WP expires. Only when you leave Canada, your WP will expire since when you return you will have to use your CoPR and immigrant visa stamped on your passport. Only way your employer will know that you have become a PR is when you update them about your SIN.

If you land, you should apply for a new SIN, as your status becomes a PR and technically your SIN number should not start with a 9. It is a gray area in the scenario if you do not apply to renew your SIN. My recommendation, do not risk doing this.

If they do your HR or the Contact person you mentioned in the reference letter will be contacted , which may in turn will let your employer know . I am not scaring you , I am saying its a possibility . They can't kick you out of the company just you applied PR , if they haven't helped you in providing any reference Letter , that is your personal interest and nobody can stop you.

If you Land , You have to get your SIN and of course need to update the employer for your Tax deductions and other related stuff.

Once you get a confirmation that you will be PR ( May be your employer wont know) you can request to your employer that I hold a PR and would like to work under canadian operations of company if and all they have . If no you can go back to india or even resign here , quit the company and search for new job , what the big deal ? Don't be scared .

You have so many questions running in your mind. and thats obvious too..

1) When you got your reference letter (NOC code and duties) from your employer, did not they ask you why you need this and what is that for?
2) If you dont want to reveal this to your employer about your pr application, It could be possible in some cases, Visa Officer later gives call employer and ask about applicant, then what you will do ?
3) Yes work permit will be void upon getting PR.
4) After Landing you will get new SIN, you can not use close WP.

I would say better tell your employer about your application. Dont hide. Applying/Getting PR is not a crime. I think your employer should not have any problem with this.


That's my personal opinion.

Although this is unlikely, if my employer wants me to stay longer (apply for WP extn), what will happen? If I dont land, how will my application be treated? Given the common UCI, I am sure the officer reviewing my WP extension application will laugh his butt off. I realize this is a sticky situation and the best option is to talk to the employer and come out clean. But wondering what will happen...Wonder if this ever happened with anyone?

Coming back to what you said, if I don't land, my closed WP will remain unaffected? What about tax filing? Will there be any impact? Bottomline, is it safe to assume that unless you land, you are not a PR by any means, and hence no worry at all?

I would be more concerned in that you have already deceived your employer by obtaining a letter written under false pretences
.
The chances are CIC will verify employment and experience.

I would day it is best to be honest with your employer.

Right now you could be at risk by obtaining a document in a dishonest manner. Your company could see this in a negative light which may have consequences.

I wish you luck but I don’t think it is fair to ask members advice on this type of situation. Honesty is always the best policy.

100% agree.
adding to this I am not able to understand why to hide form employer as PR filing is not a crime .

I will tell you once scenario :
One of my friend not informed employer that he filed PR and already have AOR , when employer filed WP ext then CIC issued Open WP instead of Company specific WP. (As CIC track all your history through magical number called UCI ;D) Since his employer do WP ext. process through some agency , Agency used to send scanned copy of WP to employer once they get it, at last his employer came to know that he already applied PR that's reason he got BOWP. by doing this he created a bad image in front of Employer/manager . and now imagine situation if CIC ask or call for any specific doc related to employment how he will face his manager.

So be honest . Brother life does not STOP if you will not get Canadian PR, so be honest

Toatlly Agree!!!

@einstein_pr - You are planning ahead of time which is good but not always. As indicated earlier, if CIC contacts company HR , it will be clear to them that PR application was filed using some xyz letter and then before getting PR itself you may get queries around letter.

Also, please note that if you are approved and issued a COPR, there is an expiration date on the COPR. You cannot wait indefinitely to land - if you don't land by the deadline, you lose your PR. How much time you have to land varies, used to depend on when you get the medical exam done (it is valid for one year), not sure if that is still the case.
