Dear Sir/Madum

I am Abhishek, have an Indian Citizenship. I was in Toronto during Oct, 2006 to Nov, 2007 on work permit. I had one year full time work experience (as Software Engineer) in Information technology field. I appeared in IETLS exam on Sep, 2008 and scored total 12 points. I have other required points from other factors (such as my work experience, education, age and number of days stay there in Canada) that will support me to apply my Canada Immigration application under Skilled Worker Category.

According to New Rule, below are set of Points mentioned on CIC webpage http://www.cic.gc.ca/english/immigrate/skilled/apply-who.asp

1. According to the Minister’s instructions, your application is eligible for processing if:
you have an offer of arranged employment,
OR
you are a foreign national who has been living legally in Canada for one year as a temporary foreign worker or an international student, OR
you are a skilled worker who has at least one year of experience in one or more of the occupations listed here.

Currently I am in India. I have following questions related to above mentioned rules.
1. Now am I eligible to apply an immigration application from Canada itself, if I go to Canada on Work permit in near future? In other words, I came to India (from Canada) in year 2007. I would like to know, will CIC consider my one year Canada stay (Oct, 2006 to Nov, 2007) during my application eligibility criteria?
2.What should be minimum work permit durations (in months) for Foreign Skilled Worker to apply for application? [/color]

Your one year in Canada will not make you eligible to apply because at http://www.cic.gc.ca/english/information/applications/skilled.asp it's clarified that they mean you need to be currently living in Canada on a work permit or student visa and have stayed in Canada 1 year immediately prior to applying.

If you have good relations with your former employer or you have another employer lined up, you can ask him to apply for your AEO to Service Canada which would make you eligible to apply for immigration.

If you choose to come on a temporary work permit, you will have different options to apply for immigration. You may wait a year and apply for skilled worker, you may qualify to apply under a provincial nominee program even sooner and worst case you could apply under CEC after 2 years in Canada.

I am in same company for past 5 years. Kindly let me what is meaning of this line ' apply for your AEO to Service Canada which would make you eligible to apply for immigration."?? What is AEO??

As seen at http://www.cic.gc.ca/english/information/applications/skilled.asp there are 3 categories for skilled worker.

1. Your occupation is on the list of 38 most wanted (which yours isn't)
2. you have an aeo (arranged employment offer/opinion) from a canadian employer
3. you are living in Canada and have been for the last year before applying (which you aren't at this point)

An aeo is an arranged employment opinion, see http://www.hrsdc.gc.ca/eng/workplaceskills/foreign_workers/poarremp.shtml It will not allow you to get a temporary work permit, for that you need an lmo. An aeo will allow you to apply for skilled worker though.

If you are with the same company for 5 years and it was this same company you were working for during your one year in Canada 2 years ago, why do you not just ask them to transfer you again? Ask them to apply for your aeo so you can apply to immigrate right away or ask them to get you a work permit again so you can apply for your immigration later while you are in Canada.

Hello Leon,

Come to Canada on WP means my company treats like deputation, not AEO. Once my assignment over, I have to come back to my native country. I know that my company doesn't offer ‘Arranged Employment Offer/opinion’ due to current market situation.

I have posted another request on this forum with all my details. Kindly check the same and let me know your valuable suggestion there.

In that case, try to find another employer in Canada who will give you an AEO or you let your company bring you to Canada on an assignment and look for another employer in Canada while you are there. When your company wants you to go home, maybe you will have another job already. I saw your other post. I don't think they will re-open your other application.
