Hello all,

I need expert advises. I have an issue here. Here is my case:

My wife have recently been nominated for SINP and also, I have name included as a dependent. We are now preparing the file for Federal application. I have a concern here. I went to New Zealand on a study visa way back in the year of 2002. Started off good but lost track of my studies in the middle. My passport was stolen in the meantime which I reported to the local police authorities. Also, I have a lost passport police certificate. Call it my carelessness, my visa expired in the meanwhile and I overstayed in the country.

Meanwhile, I was pulled up by cops only to discover my overstay status. After a few days, I was deported in 2006. After I came back, I paid the removal costs in full to the New Zealand embassy from my home country. Since then, I have worked with many MNC's (Barclays, Dell, British Gas, etc.) Currently I am employed with an IT company. My academics scores in my home country and initially in NZ are in good standings.

I have checked with NZ police authorities if I have any criminal records which they said i dont have any. I had one pending fine which I paid immediately. Also, I have no criminal record certificate from the Ministry of Justice NZ. Since that certificate is not considered good enough by the canadian immigration authoroties, I checked with the NZ police authorities of all my criminal records. They got back to me saying I dont have any criminal record but there was an assault reported against my friend and my name was mentioned as well. I was simply with my friend when he had a fight. His GF pushed him away. I simply tried to keep them apart. Police authorities told me even my name was reported.

How strong are these allegations. I was never convicted while I was in NZ. They said it is not a charge. How serious is this for my Federal case. I got to know of this recently. What do I about this. I am scared when the immigration authorities will do a security check, they might get this information. Though the NZ police authorities told me that I have no criminal record and no such information is passed to any foreign immigration authorities. Do you have any idea which body exactly the immigration Canada will be doing a security check with?

In the SINP, my wife mentioned already about my overstay status which we were told by SINP immigration officer that it should not be a concern.

Please advise me on how should I proceed. We are thinking of applying for federal real soon.

1. I suggest you look at question 6(e) on the Appendix A of the application. You lie, CIC finds out (and they will) 5 year ban. But it is your application to do as you wish.

Overstay has already been notified to CIC via two visitor visa applications and SINP application. I believe that is the question u r referring to.

It wasn't an "overstay" in your post you said you were deported, there is a world of difference between the two.
