Hi there

Do International students are still eligible for one-year exemption after getting PR as before (1460 days -365 days already in Canada during studies).

e.g. My brother got PR in 2012 and got his Citizenship in 2014 (at that time he had to live 3 years in Canada after getting PR and he got exemption of one year as an international student being already residing in Canada).

Kindly advice/share opinion

Thanks

No - there is no exemption under the current citizenship rules. Only residency time after PR is counted.

[No, only time as PR counts.]

Legislation which will reduce the presence requirement to 1095 days within five years, and which will also restore credit for time in Canada as a student, has already been passed in the HoC and is currently in third reading in the Senate. This is Bill C-6, regarding which there are numerous topics here discussing its progress. These changes are likely to be adopted, perhaps soon, but it may be a good while before these particular changes take effect.

Otherwise, note that that credit for time in Canada while a student (after the changes take effect) will be one-half day credit for each full day present, total of up to one year credit, and limited to time in Canada within five years of the date the application is made (new requirement to be a 3/5 presence rule).

It was similar before, that is that the credit was for a half-day for each full day present, up to one year total credit, counting only time within the relevant four years (when it was a 3/4 rule).

Thanks for the update....much appreciated
