Hi,

I am separated but still married. Do i still need to put my husband as my dependant in form IMM008? Or he will just be a part of my personal info (as my ex). I am confused because i told sinp about my situation and they replied to just put 3 members (me and my 2 kids) in the number of household members. However, it is stated (instruction guide in filling up) that spouses should be included, even he is not coming. If i do so, i do not have the other infos about him (there would be too many N/As) because i really dont care about him and i do not know his whereabouts for so long. Pls help. Thanks in advance.

No you don't list your husband as a dependant.

BUT, to do so, you will need to show proof of legal separation, & also legal (court) documents proving you have sole custody of your children and the right to take them out of your home country.

Our annulment case did not pursue. It was dismissed because he could pay his counsel anymore. I got here some docs to support that we had an annulment case (like subpoena and notices and status of our annulment case).Should I need to submit it as a proof that he filed against me?
He just signed an affidavit stating that he is waiving all his rights and custody over our children. and also signed IMM5604. I also made an affidavit that we are separated for many years and single handedly raising our children. Would that be enough?

I am also confused with what to fill up in this IMM008 question #14

Have you been previously married or in a common law relationship?
(including the inclusive dates...i considered him as my ex but we are still married. I do not have common law partner as of now.)

He filed for annulment of marriage but case was abandoned. you did not file for annulment of marriage.
you are still legally married.
he is non-accompanying family member.
attach the papers you have and attach an explanation letter.
because in absence of information thats all you can do.
except getting a legal divorce.
also include a copy of the response you received from SINP office.
is the affidavit a legal affidavit?
if going the court path for legal divorce is not what you want to pursue then you can let CIC decide what they need.

Thank you ifeedly. The affidavits I have here I think is legal. He made oaths in front of a notary public lawyer with their seal.

Annulment process in our country, Philippines, takes so long and very costly. But later, I am very sure that I will divorce him. As of now, I am making alternative way to exclude him in my application.

I will take your advice, I will attach an explanation letter and attach the documents/proofs I got here to support my claim, that we are separated and there is no chance to reconcile.
