Exception leave the country ( In land application )

I was wondering if anyone could give us some advice on our situation.


Me and my wife submitted out paperwork for an inland application. We sent it at the beginning of March. We submitted a visa extension ( visitors ) in December before my wife’s work visa expired. If my wife is approved for her visitors visa from my understanding is she can not leave the country because she may not be allowed back in. If she does leave and can not get back in then our application is basically void and we have to restart it though outland. Is there any exception to this, I am asking because her sister is getting married in the summer. She obviously does not want to miss this, is there any way she can leave the country even for 72 hours. Can we contact our MP and get some sort of support. Does anyone know anything about this?

What a coincidence! I've just posted the exactly same question in "Inland application 2010" thread this morning. (you can go check it! Some inlanders did share their experiences.)

I sent out my paper for applying PR in Oct last year. And my sister are planning to get married this summer,too! I can totally understand your wife's feeling.

I have been searching many information so far. Many Inlanders did re-enter again since they prepared the documents to prove it. Of course, there's risk. But, I decide to bring all the documents as I could (like AIP letter, PR application, Credit card statments..etc)and go back to my country with my multiple-visa.

I hope everything will going well. fingers crossed.

Thanks for the reply i read a few things... Does anyone have any advice or maybe links to other forums about this topic i ahve been looking but I have not really found anything. We are thinking to take the risk and go for 72 hours. We would go together and re enter canada together does anyone know if that would make a difference if im with her or not when she re enters?

This place is quiet at the weekend.

There are no exceptions that I know of, you understand the situation and therefore know the risk.
Inland applications have the downside that it's generally not advised that your spouse travels while you are waiting for your processing because it is a requirement of inland that they reside in Canada and if they are denied entry at the border for some reason, your application is toast.
There is no guarantee that visitors will be let back in.

The MP is not likely to be able to help.

Of course some people do get back in, the problem is, if you are the one that does not.
What you don't need is a IO that has had a bad day, they know the rules and can use them as they see fit.

Bottom line, it will be a risk and it completely depends on the IO at the port of entry. You may be lucky, may be not. I don't think, local MP will be able to assist you in regard to this. So, decide accordingly.

Thanks everyone. It is such a hard choice ! I read that quite a few people were allowed back in. I have to discuss this with my wife more. I just hate to think that she may miss her sisters wedding!


So if we decide to go what else should we bring with us? Right now we know to bring:

Marriage certificate
Proof of payment to CIC for application
Application

Is there anything else we should bring with us to help us when we see the IO?

Basically, proof of payment for the PR application and/or copies of the application itself will not guarantee re-entry. Did you know that when someone is non-visa-exempt, they are denied a TRV to come to Canada because they cannot prove they are a genuine temporary resident by virtue of having applied for permanent status?

That said, officers at US/Canada port-of-entries are usually a bit more accomodating - especially when the sponsor is accompanying the applicant into Canada. But the information you've probably read about your accompanying her and carrying proof of the marriage, your financial support and the PR ap in process is more applicable to situations in which someone has applied via the outland PR process, or is coming into Canada and will apply once they're here. Once the inland PR application is submitted, the applicant is required to be resident in Canada with their sponsor to be eligible under the application. If you can get her back in - then no harm done because she will be able to attend (within Canada) any required interviews, etc., = including the all-important landing interview. If she can't get back in, it's not that they will automatically void her application - she'll simply be unable to attend her landing interview and won't be able to get her PR.

The other consideration is that the "implied temporary status" she is now under for having submitted her extension application with her inland PR application will be voided if she leaves the country, although if they never find out at CPC-V that she left, they probably wouldn't know to void it. Just be aware that the decision is made at the port-of-entry - according to the officer's discretion - and having an inland PR ap and an extension to her temporary status in process will not guarantee re-entry after leaving the country.

She is from a visa exempt country she is from Germany.. does that make any difference like she is more likly to be let in. We are hoping her visits visa is approved by the time she leaves. So we would be leaving for 72 hours and returning with a visitors visa.
