Hi,

I got my pr card in June 2012, I was in canada for 7 months. I then had to get back to my
Home country to get married. I then had my child the following year so was not able to get back to canada.
I am coming back to canada next month, as my child is a bit older I am able to leave her and travel.
I have been outside canada for 3 years and 6 months.
I still have 10 months validity in my PR card.
I want to know if I can enter canada?
And will I be reported??

Would be great if you could help me out in this.

Hi

Yes, you can enter Canada.

However, as you don't meet the Residency Obligation, you may be reported on entry. As you have no H&C reasons for not meeting the RO, you can expect to have your PR status revoked if you are reported.

If you are able to enter Canada without being reported, you will be required to remain here for at least 2 years in order to meet the RO. You will not be able to sponsor your family until after that time.

Applying for PR

Hi I am hoping someone can help me here.
Recently we (hubby & I ) got our parents and grandparents Super Visas and are soon moving to Canada.
I have two questions to ask if I can.
First.. Once we take up residence in Canada do we have to wait a certain amount of time before we can apply for PR? I have looked on the web but couldn't find the answer.

Second.. :eek: I am also having trouble trying to find the correct forms for PR, again looked every but it really does get confusing for us oldies.
If any one can help with the form numbers that would be fantastic or where to look.

i was hoping the company I went with for the visa would help but they only will if we sign up with them again, and to be honest they charge too much.

There is a cap on applications and that cap has already been reached for this year. You must meet the low income cut off for three years in a row (unless you live in Quebec) to qualify to sponsor parents/grandparents. This income must be from Canadian sources and you must provide CRA notice of assessements to prove you made this income. If you are applying in 2017, then you'll need to provide NOAs for 2015, 2014, and 2013. The cap opens each january and fills within days.

Just to add - if you just recently moved to Canada, it will be a minimum of four years before you can apply to sponsor them.

If you're reported, then you can choose to appeal it on H&C reasons and you will still be allowed to enter Canada. The appeals process can take a couple years, during which time you can't apply to sponsor your family and most likely at the end of the appeal you will lose and have your PR status revoked anyways. Of course this is just based on your short description here of not meeting RO due to getting married and having a kid and not wanting to return to Canada to meet your RO. IMO this is not a valid H&C reason, but that is just my opinion.

Even if you make it back into Canada without being reported, you will then need to live here for 2 straight years without leaving to come back into compliance with the RO, and only after 2 years can you apply to sponsor your family. So most likely you won't be able to see them for these 2 years (unless they can get a TRV to come visit).

Yes you can get a temporary PR card (I believe needs to be renewed yearly) while your appeal is in process. However as mentioned, you can't sponsor your family.

see reply #6 personal view but if you leave Canada whilst the appeal is in process that might not be seen favourably that you intend to reside and meet your RO.

And if it doesn't get approved, will this affect my chances of coming to canada with a tourist visa in the future?

Hi, thanks for the prompt response.

I am really terrified to meet the officer at the Airport.
If they report me, or order for me to leave.
I have 30 days from time of entry. Correct?
And if I get an order to leave.. Is that a negative mark on my file?
Incase of future tourist visas?

Thanks for that but from the sound of your reply we have to be sponsored is that right? Can we not apply ourselves or doesn't it work that way.

We did hear that the cap had been reached for 2016 but wanted to prepare for 2017, I know the application can't be sent in too early which is understandable.

Are you coming on a work visa or as PRs?

If on visa, then you will need to qualify first and apply for PR on your own.

Only after you get your own PR status, can you then look at sponsoring your parents for PR. To qualify to sponsor parents, you will need to show 3 years of income earned in Canada meeting LICO for your family size. Income earned while you're here on visa only and not a PR, will still count to this income. But you must be a PR to sponsor parents.
