Entering in Canada after two years need your guidance

Hi;

I am Sanket Vohra. I first landed in Canada in May 2012 under FSW, I got a job and worked in Winnipeg for three months, unfortunately due to my mothers deteriorating health conditions i had to return back to India in September 2012. Now i am going to return to Canada on 29th September 2014. I have my PR Card with me which is valid till July 2017

I wanted to know whether there would be any inquiry or problems from Immigration authorities upon my return to Canada, Also what precautions and preparations i should make to enter Canada smoothly.Any documents that i need to keep handy at the time of landing etc.

Also i would like to know that as i had stayed for good 4 months in Canada in 2012, can i return to India for 15 days every year as a vacation and still continue to hold my PR and renew it once i have crossed stipulated requirement of 730 days out of every 5 year period.

I don't think you have anything to worry about. The maximum amount of time you can be outside Canada is 3 our of 5 years. Since it will only be two years since you left, you are fine. You should have no problems coming back to Canada as anyone can clearly see you still can meet your RO because of the issue date on your PR card.

And you should be able to leave Canada 15 days a year and meet your RO without issue (assuming you don't take long trips elsewhere).

Thanks Keesio for your encouraging words, One more thing i would like to add to my question above, During my stay of Two years outside Canada, My passport which was stamped with single entry Visa and my entry in and exit out of Canada has expired and i have got a renewed passport but as is obvious the number is different from the former passport, Would this create any problems at immigration as my all data would be linked to my old passport? Please note that i would be carrying my old passport with me in case it is required.

If you have a valid PR card, then that is all you need to enter Canada. The stamp/visa doesn't matter anymore.

I have entered Canada once on 11 july 2012 and stayed for 2 weeks. my PR expire 30 Aug 2017. I'm planning to settle next year around Aug 2015.
- will I have any problem entering the country or what the due date that I have to enter before.
- i'm newly married what are the procedure to allow my wife to come with me.

In order to meet the RO (residency obligation), you may spend up to 1095 days outside Canada in any 5 year period. That is 3 years less than a day. Canada immigration will see in your passport that you landed on July 11 2012 but they might not see when you left. You could have left the next day. Therefore, it would be better if you return to Canada before July 11 2015. At the very latest, you should return before 3 years have passed since you left Canada.

If your wife is visa exempt, she can come with you as a visitor but can not work or study until she gets her PR unless she gets a work or study permit. She is not eligible for a work or study permit based on your PR. She would have to apply and qualify for that on her own. If she is not visa exempt, she could apply for a visit visa, study permit etc. However, spouses of PR's and Canadians are often denied temporary visas based on that they might overstay in Canada.
