All,

1. I am planning to move to Canada (from the US) on a Work visa in the next month. I am wondering if there will be complications at the consulate (during visa issuance) or at the border (during work permit issuance) because of the fact that my PR application is in progress. My signature has details of my timelines..

2. Also my wife intends to apply for her own work permit after we enter Canada, since I hear dependents are allowed to apply for an open work permit. Any experiences to share on the timelines we can expect in her work permit being approved.

3. Also can she leave Canada on a vacation while her work permit has been applied for..

Appreciate inputs from seniors on cautions I need to take and general suggestions. Like everyone else, I am also secretly hoping for a response from Qorax to my post :)

I haven't started the process yet. Expect to apply and get the TRV/approval from the Canadian consulate in a couple of weeks..If that goes through, expect to travel into Canada end of May.

In that case you might face problem, as you have already intended to live in canada on permanent basis, Immigration officer would not satisfy that you will return at end of your temporary visa. I know you will get your PR by that time so no need to leave Canada, but immigration officer may not think same way.

Hi,
In my case it was a facilitator rather than an obstacle.

Visa Offficer at CHC as well as Border officer acknowledged my PR application and in fact told me that by the time my 3-year work permit will be expiring , my PR would have been approved.

Wife applied for open WP along with me , was interviewed (not me) and visas issued.

So you should have no problems on this point alone.

I do not think applying for a work permit would affect your PR application. I was in a similar situation in 2009 where I got an offer for a job in Canada (which I did not accept later) and the employerin Canada made enquiries about this scenario. The office told him that applying for a work permit would not affect a pending PR application.

You can get inputs from others also.

The simple answer to that is : "No Problem".

U r good to go, buddy. While the PR is on, a WP or TRV is not a concern of the CIC... the Visit Visa/s are. Similarly, at the POE too u r not likely to face any hassles.

I dont know anyone personally faced this situation. But in general while issuing temporary visa officer's main concern is that person should leave country at the end of visa. But if it is work permit then I am not sure. As qorax said, you may not have any problem.

Thanks Qorax and everyone else that replied.. I spoke to the Canada visa department head in my company and she said PR application should not have an impact on issuing a work permit. Although I spoke to a friend of mine who had issues with work permit issuance because he had a PR application pending but that was 2 yrs ago.

I will keep folks posted as my case progresses.

Hey everybody,

Just wanted to let everyone know that I got my 'short term work permit' Canada visa stamped. I am planning to enter Canada on the work permit in a few days. I clearly mentioned the fact that I have applied for the PR in the application form for the work permit but it didn't cause any issues. Hopefully things will be fine when they actually issue the work permit at the PoE as well.. Had a couple of questions if any of the experts could answer..

1. I am driving over from NY to Canada with a trailer in tow.. What should be my PoE? I hear there are a few options other than Niagara falls.. Is one better than the other? Any suggestions?... Also any ideas on what kind of delay I should expect? I will be driving in on a Sunday..

2. Would it be beneficial for me to send in a letter to the Buffalo office (where my PR application is in received status) informing them that I have entered Canada on a Work permit in a role that fits the NOC 0213 code to a T. I can see the logical reasons why it would help the visa office making the decision on my PR. Just wanted to make sure I'm not missing anything that might make sending this letter a bad idea!

Dual Intent

Dual Intent refers to the concurrent processing of an application for Permanent Residence and an application for Temporary Status, therefore demonstrating the intention to both reside in Canada permanently and only temporarily, at the same time.
Although this may appear contradictory at first glance, in fact it is possible. Imagine, for example, the following scenario:

An individual submits an application for a Canada Immigration Visa. Before receiving the Canada Immigration Visa, the individual wishes to visit Canada for a short time and applies for a Temporary Resident Visa (TRV), or appears at the Port of Entry, if a national of a TRV exempt country. This is perfectly acceptable as long as the individual intends to leave Canada at the end of the visit.

The same principle applies to individuals who are in the process of applying for a Canada Immigration Visa and wish to obtain a temporary Work Permit or Study Permit.

An individual whose application for Permanent Residence in Canada is pending is subject to the same requirements as others when seeking entry into Canada temporarily. The individual should therefore have a reasonable purpose for entry, be prepared to leave Canada at the end of the temporary stay and understand that if a Canada Immigration Visa is issued, he or she must leave and re-enter Canada in order to officially land as a Permanent Resident.

An application for Temporary Status may be scrutinized more closely when a Permanent Resident application is under review, as there is an obvious intention to settle in Canada permanently. If the individual's ties elsewhere can be demonstrated, however, an application for Temporary Status should succeed.
