Hi folks,

I got nomination from BC PNP and applied for Work Permit to CHC Delhi. Got a letter from VO saying "Specifically I have concerns with the authenticity of your employment references as it was verified and confirmed to be fraudulent." I was given 30 days to respond else my application would be refused and I would be in-admissible in Canada for 5 years for mis-representation.

I am working as a freelance textile designer. I submitted the work experience letters from my 3 employers to PNP in December, 2014. I did not procure new letters from them and I submitted the same ones along with my Work Permit application to CHC Delhi. I thought that all the verifications have already been done. The business address of 2 of my employers and the landline numbers of all 3 of them have changed and are not what was mentioned on the letter heads.

I have replied to the VO saying the following:

Regarding my application, I was really shocked to read the contents of your letter. The employment references in my application for Work Permit are authentic and are not fraudulent. After thinking deeply about what could have led you to such an opinion, it comes to my mind that it must be due to the change in the business address of two of my employers and also the landline telephone numbers of all three of my employers. However, their mobile numbers are the same. I did not procure new letters from my employers indicating the new addresses & landline telepone numbers because I thought that only change in my address or contact number was relevant and needed to be intimated. I have submitted the same documents and letters from my employers for this Work Permit application, which I did in in the BC PNP application in December 2014. I assumed that all of these have already been checked, verified and that your office must have received all the information. I realise now, that I should have submitted the current addresses and landline telephone numbers of my employers, along with my application to you. I sincerely apologize for this negligence.

Attached along with are latest letters from my employers confirming the change in their addresses & landline telephone numbers, photos of their business places and documentary proof that they are all authentic. Hoping for positive result soon, so that I can start my job in Canada as soon as possible.

I have submitted copies of registrations of my employer's firms with various Govt. departments, new landline telephone bills, their mobile number bills, experience letters on new letter heads indicating their present address and contact numbers, an affidavit from one employer with whom I was full time employed previously, photos of showrooms and factory of 2 employers etc. It's been 2 months now. I have not received any response. I am getting very anxious.

Could anyone please let me know:
1. In how much time should I expect the response?
2, What would be happening to my application at this time?

There is no response time for submission of additional documents to CIC, even if those are requested documents- I would say, in general, that if it has been two months since you submitted the letter, and you haven't heard back yet, that's good news, because the letter makes it sound like you were on the verge of a rejection for misrepresentation.

My assumption is that CIC decided to look into the newer details you provided them with, and verify those to ensure that you were telling the truth in your explanation letter- this would have delayed the processing of your application a bit.

On the whole, however, not having heard anything back from CIC is definitely good news. If you are concerned about the state of your application file currently, I recommend ordering your GCMS notes, that basically give you access to your file as is in CIC's system. Plus, if you applied under Express Entry, and it has been over 180 days since you did, you can also start calling the NDVO and enquiring about the status of your application.

On the whole, though- I'd say don't worry.

I was called for an interview with the VO a couple of days ago. She asked me how did I get the job offer from Canada. I told her how. Then, she told me that she had serious concerns regarding the authenticity of my employment because I did not submit any pay slips or other documentary proof of payment received. I explained her that since I was working freelance and got my payments on cash, I do not have any of these. I only sign the cash payment vouchers of the employers at the time of receiving the payment. So, the consultant hired for my paper work by my employer in Canada, told me to submit employment reference letters only.

She also told me that my employer's offices were contacted and the manager there said that they do not have any freelance work done and that he did not know me. A person at managerial level should at least know about me. I told her it is not so. I am working on freelance for them and that I only need to meet my employers (owners) and discuss the design they want. I make some of them as per their needs and meet them again for approval and submission. I do not need to meet anyone else in the organisation and I am working only on freelance. I do not even need to meet anyone in their in-house design department to discuss my designs. Then, she said that she has to go for a meeting and asked me to wait outside.

After 20-25 minutes, I was asked to come in the room. She again asked me whether I really do not need to meet anyone else. I told her so again and explained. I also told her that there are a few people in these companies whom I greet, when I meet them and they know me.

Then, she asked me questions related to my work and relevant job. I gave her all the answers.

In the end, she said that "Ok, I'll consider your application but I have to wait for a response from PNP as they have asked to put this application on hold."

Could you please advise what could be happening. I am already late in reaching Canada for my job as the employer wants me there ASAP. She gets a lot of orders before Christmas and has plans.

It's hard for any of us to say what is going to happen. CIC is considering the responses you provided in the interview and will then make a decision. This may be positive or it may be negative - again, impossible for any of us to say. Not much you can do but wait and hope for the best. Good luck.
