Hi Everybody.

I worked with this employer for few months(4 months to be precise) and then he fired me because I got job offer from new company. It was NOC job code 2175. Recently, I became eligible for Express Entry so I thought it will be a good idea to gather required documents beforehand.

I contacted him explaining everything and his reply was that They don't give job letters to terminated employees. I have my ROE and job contract letter.

I want to know what are my options now? Goto Ministry of labor or explain it to CIC or contact lawyer?
 
Is this employment helping you get any CRS points? If not remove it from the work history and add it in the personal history section once you obtain your ITA - you won't be required any proof.

Otherwise is there a former colleague or manager who could write a declaration of your duties and responsibilities? If you provide what you have + this letter + proof that he refused to provide a reference letter then it might be sufficient proof to claim those points.
 
Getting a letter from the employer is not easy. I had to beg and plead to get mine especially from my previous employer where I didn't leave on good terms. Ultimately, I got it.
 
Yes; getting employer letter is the first most time consuming thing. The second being PCC ( US FBI ; dont know about other countries.)

So plan accordingly.

As others have suggested - first determine if that 4 months is going to benefit your CRS score in any way. If it does not, then simply exclude it from your profile (if you get the ITA, you will need to include it on your background history).

If it does make a difference - e.g. that 4 months gives you 2 full years of work experience instead of one - then... You have the ROE, job contract letter, and presumably your T4, those are strong supporting documents. Then write a letter of explanation about your employer's refusal to give you a letter. Provide proof if you have it (e.g. if you got their response by email). A letter from a former colleague would also be helpful (esp. if they can describe the job duties you performed). If you have all that, then you have done the best you can do. But the letter of explanation is essential.
 
As others have stated these are the steps I would take:
1) Determine if it will add to your points, otherwise put it in personal history
2) If you need these points get a letter from a co-worker, human resources or someone senior in the company
3) Attach the email where your employer says they can't give you a letter
4) Also include any other documents to support: T4, contract, pay stubs, etc
5) And lastly a letter of explanation that you tried to get it but was denied

Yes this job is definitely getting me points and become eligible so I will have to include it.

I have all the supporting documents (t4, contract letter and ROE). I have good connections with Co workers so I will get someone to write a letter for a me. And yes I do his email where he clearly refuses to give letter
