ON BEHALF OF SOMEONE
Yesterday I met up a guy went to Canada with visitor visa and filed a refugee claim. As soon as his claim has been rejected he returned back home rather than overstaying. While staying Canada he got 1 and half year of work experience with valid open work permit. Well, before he left Canada he got study permit approval but refused TRV applied from back home, refusal ground was like : "Any history of contravening the conditions of admission on a previous stay in Canada. Study permit issued was err". He is confused whether or not he can apply under CEC? He also obtained 11 months full time experience on the same skill type in his own town most recently. I'm wondering, will IRCC count his Canada work experience? Or he needs to apply under FSWP after a month?

1. No his work in Canada would not be counted.

Why? He worked with valid work permit though. He went to a consultant stated it should be counted, but another said NO. Well, Could you please explain a bit detail? if it wont counted then can he be eligible for FSW after 1 year experience in his country?

Several immigration program is not available for people who had refugee claim in Canada before.

He was on a refugee work permit on which any work done would not be recognized as skilled experience for any of the immigration programmes....

Most likely the only way he would be able to come to Canada is through a spousal or family sponsorship. That is no guarantee either.

Work gained while in Canada as a refugee applicant cannot be counted as work experience towards any Canadian immigration program.

this guy is desperate !! unless otherwise, can he apply under FSW if he meets eligibility criteria like, min work exp,education, IELTS etc? I think he is not inadmissible, is he?

This guy will open EE profile any way. seems crazy. he says, he will open EE profile and claim for Canadian work experience and backhome experience too. if cic wont count Canada work experience, there is no logic that they wont count foreign work experience and consider me under FSW.

Bad idea. Not sure how many times you need to be told - the Canadian work experience can't be counted. If you misrepresent your application and say you have Canadian work experience - and end up being accepted under CEC - they won't switch you to FSW when they figure out you don't qualify - they'll simply refused your application. Best case scenario you're looking at a refusal. Worst case scenario you're looking at a refusal and a misrepresentation ban.

But feel free to ignore our advice. Your life.
