Eligibility of Spouse Open Work permit for Alberta Express Entry

I am currently a student whose study permit and thus my wife has a spouse open work permit.

We both live in Alberta and we are planning to apply for Alberta Express Entry program through my wife's work experience in Alberta.

However, I am not sure if the spouse open work permit is eligible for the Alberta Express Entry Program.

I found that in the case of Alberta Opportunity Stream (AOS), there is a Visa requirement, which does not allow spouse open work permit.

Whereas, I could not find any visa requirements for the Alberta Express Entry program.

In my understanding, since Alberta Express Entry program draws qualified applications from the federal Express Entry pool, the requirement is subjected to the Federal Express Entry requirement, which allows all kinds of work permits to be eligible.

For making sure, would you kindly advise me about the eligibility of the spouse open work permit for Alberta Express Entry program?

who told you that an open work permit holder, that is your spouse can not apply for AOS? has she completed 12 months work experience in alberta?

Does anybody get an answer is it possible to apply for Alberta Opportunity Stream with Open Work Permit? My wife has the same situation with more than 3 years of work experience in Canada and a permanent job in Alberta.

Yes for sure, there are specific requirements, but people with Open Work Permit are not included in the ineligible list as well. The main criteria should be work experience, not the type of work permit you have. It is simply not fair that people who already living, working, and paying taxes in Alberta are not eligible.

So someone with the same crititeria applied and their spouse got through this year. So I'd say go ahead and try. I will try once my partner reaches the 1 year mark.

If your spouse has the job offer and meets all other requirements then apply.

Yes, she has a permanent job, but it is not LMIA based, since she has an Open Work Permit based on my Study Permit. We made a call to the AINP and they told us you are not eligible for Alberta Opportunity Stream, because of the work permit type. So, I am trying to find answers...:)

Based on eligibility requirements she is not eligible as she needs to be on PGWP or LMIA. @Tavia says it is possible so needs to elaborate.

I really don't know much. I just found someone who said their partner got it that way but haven't received much info so that's why I was also asking. I wanma do it too

Need to get details and profile from this person. The person may meet requirements or was nominated through Express Entry..

When I met the person I asked some specific questions such as, was your husband in the pool. Did his job apply for him. All those were no, never in the pool, they did nomination paper based so I was confused and came to the forum here.

Just for the information. Unfortunately, it is impossible to apply online through the AINP portal. There is a field with the question "Are you currently residing in Alberta under a work permit issued by IRCC?" with the list of choices. If you choose "other" you are not eligible. So, it is impossible to apply online with Open Open Permit. Very sad.

Ohh and they applied on paper so perhaps that's why......I'm not sure. It's ridiculous. But why didn't your partner do the TR to PR this year though?
