According to the eligibility criteria, one is eligible to apply as a skilled worker if the foreign national who has been living legally in Canada for one year as a temporary foreign worker or an international student.

my question is:
If a person lived in Canada for one year, 5 months as a visitor and 7 months as a temporary foreign worker, will he be eligible to apply for PR inside Canada or he needs to wait 5 more months as a foreign worker before he is eligible to apply?

1. Actually to apply under CEC you require 2 years of work in Canada.

Thank you PMM for your reply. We were not very keen on applying on CEC category because of the time we have to wait in order to be able to apply for PR. However, we are very interested on trying our luck on the Federal Skilled worker category applying inside Canada.

We would appreciate if you could share your knowledge on the issue regarding the eligibility of a spouse, of an international student, with open work permit to be the principal applicant? Will a person with open work permit be considered in category 3 as a temporary foreign worker?

Yes, if they meet the criteria and have arranged employment.

I believe he would be able to meet the criteria however with regards to arranged employment category, he is presently working right now but not on the NOC required by the arranged employment category 2. That is why we opted to apply under category 3.

It says you have to have been legally in Canada as a student or TFW for 12 months. I don't think the time as a visitor will count.

What about the arranged employment option? presuming that the person is presently working under the category of skill level B (supervisor)and being offered by the employer for indeterminate job once PR is granted, will he still have to wait for a year to apply for FSW or is he already eligible to apply?

One more thing, since the person is holding an open work permit, is an LMO from HRDC required from the employer or a letter from the employer will suffice?

According to the eligibility criteria, your application is eligible for processing if:

•you have an AEO, OR
•you are a foreign national who has been living legally in Canada for one year as a TFW or an international student, OR
•you are a skilled worker who has at least one year of experience in one or more of the 38 occupations listed.

Thus, ur less than 1 yr TFW doesn't suffice, BUT ur AEO does.

So, go for it buddy...

They are different categories. Somebody who wants to apply under category 2, arranged employment needs either an AEO or if he's already on a work permit, the work permit is enough plus a letter from the employer stating that they will keep him after he becomes PR. Category 3, people who've been in Canada as TFW's or students for 12 or more months do not have to have arranged employment or a skilled job and Category 2 people who have an AEO do not need to have been in Canada for 12 months.
