Eligibility criteria for BOWP

Dear forum members,

I need a clarification on the below requirement for BOWP.

As per the cic web site for BOWP requirement it says "They have valid status on a WP that is due to expire within 4 months"

My WP will expire on Jan 31st 2015 am i eligible to apply for a BOWP now.

You become eligible 4 months before expiry, that means 1st of October 2013...Cheers!!!!!

Due to expire within 4 months. Earliest you can apply for BOWP is October 1, 2014

My situation is, though i have my WP valid unitl 31 Jan 2015 but my employer wants me to return back due to no work after December 2014. So If i want to stay here then i need a new work and that is possible only if i have a open WP. can i explain this in the covering letter and apply right now is there any possibility that the BOWP application gets rejected in this case.

You will most likely be rejected for BOWP if you apply before October 1st. Anyhow, you would be asked to leave after December. You have plenty of time to apply for BOWP after October 1.

You wait till 1st OCtober and then you get it in 15 days time which is way before December 2013!!!! Hope this helps

I filed my PR in June 2014.

Thanks everyone for their valuable inputs on my query.

I applied for BOWP on 19th Aug 2014 and its approved on 28th Aug 2014.

My current workpermit was valid untill Jan 2015.

So for me it looks like if you provide right justification and some supporting documents then you may get BOWP even if the existing workpermit is valid for more than 4 months.
