hi
we got married in august 2012.my wife is canadian citizen. due to 5 years sponsership bar (because of her second marriage with myself) we were eligible to apply on 1st march 2013. we applied in march and after 1 month we got our first step approved few days back. and they said they moved file to new delhi.

our concern is , in dec 2012 before my application for pr, i applied for visitor visa and got refused. reason was family ties.
i have good travel history
1 year in england as student, more then a year in australia as student. visitor visa for thailand and schengen countries. but still got refused.

as our condition is strong now because of approval of first step we know few people who got visitor for their spouse after first step approval
we are thinking again to apply as visitor.
can someone plz help us that is their any -ve effect on my immigration application if they again refuse me. or should i avoid applying again.

It will be fine, especially since you only have 1 previous refusal. It's natural for a spouse to try to visit their spouse if they're not living together! In fact, the refusal proves even more the genuine relationship because you're trying to visit. You can always send additional documents later and put an explanation for the refusals (ex. I wanted to visit my wife, etc.). Don't worry. 1 or 2 visitor visa refusals is not detrimental.

effect of student visa rejection on PR

I was rejected student visa twice about 10 years ago. This was mainly because I was mislead by my consultant.
Now I am married to a Canadian citizen and waiting for my Visa. My husband's side of the documents have been cleared from Canada and I was asked to send my passport to New Delhi. April 27, 2013 I had sent my passport. The only status update I see is Application and Medical reports received. Although we were told by our immigration consultant our case was a genuine case, my heart wouldn't rest due to the rejections. Can u please tell me if these education visa rejections will affect my case? Also if the status is application and medical is received how long does it take for the next step or the final Visa?

Any refused visa to a Western country is a red flag. One is not a big deal. If you applied for a TRV to visit your spouse or boy/girlfriend, then explain that in the forms - CIC does have the files from the old applications, but they don't necessarily check them. They'll see you were refused, but may not see why you wanted to come in the first place - so tell them why.

The more refused visas you have, the worse it looks. Two rejected attempts 10 years ago: again, the visa officer will note this, and will take it into consideration, but it was 10 years ago, so it is not like you have been trying continuously to get into the country.

In any case, just add more proof that your relationship is genuine to counteract any negative effect of the visa refusals. One or two shouldn't be much of a problem.

To the OP: refused TRV applications before your PR application look bad (though again, one isn't too bad), but TRv applications after you have sent in your PR application should be OK. You want to see your spouse, which is normal. Still include proof that you will leave Canada at the end of the TRV, show ties to your home country, and include a letter explaining you have applied for a PR visa and do not want to jeopardize it in any way, and so will not overstay your TRV.

dear all,

once i applied for tourist visa and it got rejected. and i moved on to dubai to spend my vacations. later, I got a job offer from a company of poland. I applied for work visa. it again got rejected. as it belonged to my career so i filed an appeal. However, the appeal was not fruitful. it has been three years.

Now i am planning to move to Canada permanently. Is it beneficial for me to go through this long procedure of immigration? what do you think am i going to get rejection?

I had applied for TRV in 2016.My agent took only education credentials. I have 8 years gap after my study. Agent showed some fake experiance letters to fill the gap...! My agent misleaded me very badly. I Knew all by CAIPS notes.
Actually I have 8 years of experiance in 3 different companies..!! Now I want to apply for PR canada with my true experiance references...! Does my refusal of TRV affects my PR Application? What should I do?
When your TRV was refused - did they simply refuse your or were you given a misrepresentation ban as well for using fake documents?

Refusal reason was comman like no ties with home country., No Travel history.. etc...!
In that case I would say that you will want your evidence of employment to be extremely strong when you apply for PR since it won't be the same as the fraudulent documents you submitted as part of your TRV application. I would expect longer processing times and that CIC will contact your employers to confirm your employment.

Should I mentioned all this misleading by agent in Cover letter when I apply for PR?
I don't know.

However blaming your agent doesn't help. CIC holds you responsible for all of the information and documents included in any application.
