EE application submitted Nov 2018; questions on validity of visitors visa, open work permit/dependent work permit options, and a new addition
Hello Forum and Aspiring Immigrants,
This is my first message and a lengthy one (Three Parts I, II, III). I have been following this forum from beginning of 2018. A bit shout-out to Canada Visa and its members in answering queries for different section of people.
I am trying to understand what should be our next steps and options while our express entry applications is in process.
For your information: My wife is the primary applicant; myself and my son are dependents. We both are Indian citizens, and my son is a U.S. citizen. We received an ITA in October draw, and submitted all the documents last week.
My wife is a senior software consultant and has 6 years work experience outside Canada. And, I am a Senior Design Engineer with 6 years work experience outside Canada. We both have a Master's degree.
We are currently visiting Canada since August 14th (me and my wife have multiple entry visas until 2025). While finishing customs procedure at YYZ airport, I mentioned in one of the automated machines that we are going to stay in Canada for 120 days. There are no stamps in our passports as we did not speak with any border/immigration officers. We returned our printed slip regarding our stay (120 days) to one of the officers before exiting the airport. The slip shows all our names, DOBs, pictures, passport numbers, and length of stay.
My few questions regarding visitor's visa (Part I) are:
1. Should we leave before 120 days based on printed slip or can we stay close to 6 months as per
temporary visitor's visa staying requirements?
2. Should I contact IRCC to confirm if we are allowed to stay beyond 120 days and stay close
to 6 months?
3. When is a good time to extend visitor's visa? What is the processing time after submission?
I heard in the online forums that after submitting express entry application online, the primary applicant is eligible for open work permit; and spouse gets dependent work permit if primary applicant has NOC job type (0, A, B) qualifications and an employer who could provide a job offer in Canada. Please correct me if I am wrong and Please Confirm.
My few questions regarding work permits (Part II) for both of us:
1. Are we eligible for open and dependent work permits without LMIA as we submitted our
applications online for express entry even though we are currently on visitor's visa?
2. If eligible, should my wife have an employer based in Canada or can she apply for an open
permit without any employer?
3. If employer needed, what relevant documents are needed from them to submit?
4. Should she apply for an open work permit online by creating a new profile or is it taken care
at the border?
5. If online, can she do it by herself or do we need to go through a immigration consultant?
6. What is the processing time for open and dependent work permits after submission?
7. Is open work permit a better option, or extending visitor's visa a better scenario?
8. Any other scenarios?
We are expecting a second child (Part III):
We are expecting a new addition around June 2019. We all three have completed our medicals in first week of November. My wife took additional precautions while going for chest X-Ray. We do not have health insurance at this point of time.
1. What are our current and future options regarding medical insurance?
2. Is an applicant eligible for health coverage, if her open work permit gets approved?
3. Any other scenarios?
Miscellaneous:
Before visiting Canada, I applied for a couple of colleges for a diploma in business programs. I got admission to both the colleges starting January 2019. For one of the colleges, I did not accept the offer in two weeks (so the college made my offer invalid). Regarding the admission from another college (I'm yet to make a decision from my end, and also the college did not take further steps regarding my case).
1. What should I do?
Could you kindly reply to my questions at your earliest convenience. Your answers will be greatly useful and appreciated in order for us to make a decision.
