Personal Loan in Dubai and the consequences later?

Hi reader!

Please try to answer if you have any experience or knowledge on the below points:

First let me explain my current situation: I'am working on a full-time job in Dubai and I have no problems with it (by the grace of God). My fiancee moved to Canada last July 2020 as she received her PR and she is doing fine now and working also on a full-time job in PEI, Canada. We originally had a plan to travel together but my visitor visa application got delayed due to Covid. Now our plan is, for me to travel to Canada after I receive my visitor visa that i applied during Feb 2020. (which I may receive soon as I already have received the approved covid19 exemption travel letter from IRCC). And then after I reach there my fiancee will apply for a inland spousal sponsorship visa followed by an open work permit visa so that I can start working there while waiting for the spousal PR to be approved.

However the challenge and my question lies below:

1) I have a personal loan for about AED 80k outstanding and I have no intention to stop paying it, so after I leave Dubai, Is there a possibility that I can pay from Canada every month without missing even a single payment as soon as I get there? If Yes, how can we do it as the bank account will remain frozen after I move as I would not have any current active UAE visa to keep my account as normal. How do I contact the bank? Will they agree as they will have no choice or will they take strong actions?

2) Will the bank try to deposit the cheque which they had originally made me sign for the full loan amount while taking the loan, now assuming that I had left the country. Coz if they will, there will be a case against me which I want to totally avoid as I would like to visit UAE again in the future. Will they do that even if I pay the full EMI amount every month?

3) I do not want to miss my End of Service Benefits which I will be receiving from my employer after I resign, as I understand my account will be frozen once the final settlement hits the account. And as the bank can only release the amount once I start working in a new company in UAE and provide them with the updated documents with a new visa, So my plan was to get another job and get the new visa and get my settlement from the bank released first. Is this a good plan?

4) This question is connected to question 3, If I get a new job in a new company in Dubai, should I resign from the new company as well before leaving for Canada so that I won't have labor ban? or Should I just leave without informing the company which will make me as absconding, but is this a big offense to worry about? I will want to visit UAE in the future, not for employment but as a tourist to see the old memories again.

5) Last question, now after doing all the above steps, will I have any problems later during my spousal sponsorship application when they do the background checks and all. I will also getting the PCC before leaving Dubai so that we can start the application as soon as I reach there in Canada.

Any help will be great!

We made this plan, not to stay far away from each other anymore and during this pandemic situation we need each other more than ever. I know other option would be for me to come back to Dubai and finish paying my loan, but that would take another 2 more years even if the outland sponsorship visa is approved within the next year and thats a long time to stay away from each other.

Thanks in advance :)
Hi, long post but I read it all and understood your situation. Well, my situation was similar 5 years ago when I migrated to Australia with 32k AED loan. It was credit card loan accruing heavy interest every month. I was able to send monthly payment into credit company account and hence paid it full. Similarly, you could also make payments via western union into your bank account from which loan installments will be deducted.
Btw, how sure are you that the bank will ‘freeze’ your account when you migrate? Please call the bank and clear this.
2) Why will they deposit the security cheque if you are paying EMI every month???
3) Is this freezing of account new law implemented in UAE? I wasn’t aware of this ...
It is your final settlement and your money and you have all entitlement to it so why they’ll stop you accessing it? ( I think you are simply over-thinking mate!)

4) It will be best for you to exit UAE as per norms e.g have your visa cancelled. Visa usually becomes invalid after you’ve stayed more than 6 months outside UAE. Your company PRO can answer these questions for you.

5) Good to get pcc online from Police website ( check it first) once you land there in Canada as it will remain valid unless you enter UAE again after pcc was issued.

hope I have cleared your doubts and provided you thoughtful guidance...

Thank you so much for going through my lengthy post and providing answers. I made it long as I wanted to be as clear as possible. :))

Here are some of my thoughts and the facts as I have experienced before when I changed companies twice here in Dubai. The company deposits the final settlement salary and marks it as End of Service benefits and the bank is notified automatically of that. The account freezes until I show them the new offer letter of a new company or they might want me to provide them the new salary transfer letter from the new company, post which they will unfreeze my account. That's the rule currently. I don't know if it was there when you left.

So given the above situation, I would probably have to join another company and get my settlement released and then resign from the new company as well and get my visa cancelled before I even complete 6 months in the new company. As that's the only solution I see as of now. What do you say?

Thanks for your advise on PCC, i would probably follow what you said, get my PCC before leaving UAE, through online application.

Thanks for sharing your experience really, I would definitely contact the bank once I arrive there in Canada and arrange a regular payment. I just wanted to know if someone did that before already.

One question though - Im sure you must have completed paying it by now. Have the bank provided any kind of clearance letter after you completed paying. Because chances are these banks they dont really care to after the payment is completed and might get arrested at the airport if we come back as a tourist in the future. Dont really want to have black listed records you know what im saying. Would you care to tell me what bank it was as for me it is Emirates Islamic.. Thanks again :)

Thanks mate! take care :)

Good to know my guidance helped you. Additionally I would recommend you to confirm this with your bank as I am not aware that ‘freezing’ of rule ever existed until year 2016 when I left.
And you should get pcc when you are in canada not while you are in UAE because you will still be inside UAE. All these things you need to confirm with Canada immigration and police also if you can get this way and if it will be accepted. So do your research.
And definitely your lender must give a clearance letter once all dues have been repaid as it is your right as a client. Moreover you will have all receipts and statements with you that you made payments so no need to worry about being arrested for no reason!
and my lender wasn’t a bank but a private lending finance institution...

Thank you again. I will probably do more research on the PCC and the processes involved for the legal acceptance procedures.. and yes about the bank rule, it is correct, they do freeze the account as I have spoken to them also.. Thanks for clearing my doubts! Cheers!

Dear all,
I recently took ielts, but I used my Emirates ID (UAE National ID) to register for the exam. Hence, the name on ielts is my name plus my father's name. On the passport, its only my name obviously, although my father's name. Is mentioned in the "Father's name" section in passport too. Is this a problem? If yes, any work around for this?

Really shouldn't be an issue. You can probably attach the Emirates id copy with your documents to be in the safe side. You can also arrange for a signed affidavit stating that it is indeed you who has the 2 different names

Hi Guys,
I have a PR & plan to move to Canada from Dubai in Jan 22. Are there any specific documents I may need to carry? As an example, for driving license in Canada, I was told to carry UAE driving history that's issued by RTA. I would assume that history card from my car insurance may be helpful too. Anything else that you seem important? I have an active bank account in Canada already so nothing needed on that front.

Hi
Can anyone suggest how to transfer funds to Canada? Scotiabank doesnt have a branch in Dubai and i am unable to get a draft facility from my bank.
Any suggestions would be welcome.
Here is what I did in July 2017. I got a manager's cheque issued from Emirates NBD where I had the account and then closed the bank account
I took the cheque to UAE Exchange in MoE, where they wire transferred the amount to my TD bank account. The wire transfer came within in 3-4 days from the date of transfer.
Reach out to TD or other local banks here in Canada to see if they will allow you to open the bank account remotely without you landed in Canada

RTA driver history is good to have if you wanna avoid going through long driver test router here in Canada.
Most insurance companies do not accept UAE No claim's letter. All State does that but again it differs from agent 2 agent.
if you are travelling with children keep their original birth certificate with you in your hand baggage. You may be asked before you board

Thank you for your feedback, Abbas!
Could you also help me with this - Can I drive on an IDL or Dubai driving license for 60 days after arriving as claimed by a few others on this thread?
I'd like you to know that I landed in 2019 October and returned to Dubai, made another trip to Canada in Jan 2020 and returned again. During both these trips, I drove on an IDL. So now, when I finally move for good in a few months, can I still drive on IDL/Dubai license for a few days before I manage to get my Ontario driving license?

Hey Azhar,
Not sure if I will be able to answer your question...
Here is my own experience...
I got the IDL from Dubai when I was leaving the country.
I moved here on a work permit.
When I rented the car here in Toronto they did not even ask me for the IDL.
All they asked me was the current drivers license..
