Hi,

I was approved to sponsor my husband in September 2014. We are currently living in Australia awaiting approval for his PR. My question is can my husband apply for International Experience Canada or Temporary residency in accordance with the following regarding Dual Intent:

A22(2) states “An intention by a foreign national to become a permanent resident does not preclude them from becoming a temporary resident if the officer is satisfied that they will leave Canada by the end of the period authorized for their stay.” Dual intent is present when a foreign national who has applied for permanent residence in Canada also applies to enter Canada for a temporary period as a visitor, worker or student. Dual intent on the part of the applicant is therefore not prima facie grounds for refusal of temporary resident status'

According to the website ‘ If you participated in IEC before 2015, you are eligible for a final participation of up to 24 months in the category of your choice.’ My husband has participated in IEC from 2011-2013.

Can he apply for IEC a second time and if approved is it possible for us to live in Canada and await his permanent residency with him working there?

Appreciate any help!
 
yes, he can certainly apply for another IEC work permit. he can even come to canada as a visitor and stay there for the duration of his process. if he thinks he can get the work permit, that's even better. there are no rules about applying for more than 1 visa at a time, and any approval/rejection for another type of visa will have no bearing on his PR application. he is free to travel to canada whenever he wants.

Other question is, if we did go this route and he got approved for a second IEC and went to Canada to wait approval for PR, what does this mean for our application, if we had applied outland and then we go to canada to wait approval? Will the application still be considered outland and we just have to update our address information? I am probably jumping the gun and just trying to find a way we can be in Canada earlier. 15 months seems a crazy amount of time to wait for processing!

All an outland app means is the app is processed in an outland visa office. Where the applicant is actually living is irrelevant, could be Canada or any other country. Make sure to change address with visa office to Canadian address after you arrive here, and when PR is approved they will send all landing documents directly to Canadian address.

Posted times on CIC site are more worst case times. Majority of apps are done much quicker. Some applicants through Sydney office are getting processing times in 4-6 months.
